Washington Demands Answers Before California Counts
The Trump administration has escalated a major election integrity dispute, demanding that California officials investigate approximately 20,000 registered voters federal authorities suspect may not be American citizens.
The Department of Justice has asked election officials across California’s 58 counties to verify citizenship and temporarily separate ballots associated with people whose eligibility remains unresolved.
California officials are resisting, questioning the accuracy of the federal government’s information and warning that last-minute changes could interfere with lawful voting.
The confrontation has reached the federal appeals court, raising a constitutional question that extends far beyond California.
How do we prevent illegal voting without allowing government agencies to wrongly interfere with the votes of American citizens?

A Federal Warning Meets State Resistance
The Justice Department says investigators working with the Department of Homeland Security identified more than 20,000 registered voters whose records suggest they may not be U.S. citizens.
Federal law already prohibits noncitizens from voting in federal elections, with limited statutory exceptions.
The administration argues that California has failed to adequately investigate potential violations and wants ballots associated with the flagged individuals held separately until their citizenship can be verified.
Federal prosecutors have also warned county election officials about potential legal consequences if they knowingly count unlawful votes.
The Justice Department maintains that its objective is election integrity, not the automatic cancellation of registrations or ballots.
But California officials dispute the reliability of the federal list.
A preliminary review of 200 names by Los Angeles County officials found significant problems. More than half of the sampled registration records were canceled or inactive, approximately 70% showed no voting history, and nearly 39% of records containing meaningful birthplace information indicated the individuals were born in the United States.
Those findings do not establish the citizenship status of every person on the list. They do, however, raise legitimate questions about whether federal investigators have correctly identified the people they suspect.
Federal officials have acknowledged that some individuals on the list may ultimately prove to be citizens.
Meanwhile, federal prosecutors have separately charged 28 foreign nationals in California with alleged unlawful voter registration or related election offenses. Those criminal allegations must be proven in court and do not establish that the broader list of 20,000 contains 20,000 ineligible voters.
California Attorney General Rob Bonta and Secretary of State Shirley Weber argue that the federal government has not provided sufficient evidence to justify its demands.
The dispute has moved into the Ninth U.S. Circuit Court of Appeals as the Justice Department seeks emergency intervention before ballots are counted.
The legal conflict involves federal authority to enforce voting eligibility requirements, state responsibility for administering elections, voter privacy, and the practical consequences of changing election procedures while voting is underway.
No court has established that 20,000 noncitizens illegally voted in California.
The number represents individuals flagged by federal investigators, not a verified count of unlawful ballots.
The courts must now determine whether the administration has demonstrated sufficient legal grounds for the emergency restrictions it seeks.

One Illegal Vote Is Too Many. So Is One Wrongful Rejection.
The Go Right with Peter Boykin Perspective
First of all, I support President Donald Trump, and I strongly support ensuring that only eligible American citizens vote in our federal elections.
That should not be controversial.
American elections belong to American citizens, and states have a responsibility to maintain accurate voter rolls and investigate credible evidence of unlawful voting.
But being a Constitutionalist for Liberty means recognizing that government power must have limits, even when we agree with the government’s objectives.
If federal investigators have reliable evidence that someone is unlawfully registered to vote, that evidence should be examined and appropriate legal action should follow.
However, suspicion alone should not automatically become proof.
I do not want noncitizens voting in American elections. I also do not want eligible American citizens having their ballots questioned or withheld because a government database incorrectly identifies them.
Both outcomes undermine election integrity.
And both deserve our attention.
The federal government has a legitimate interest in enforcing federal election laws. States also have constitutional responsibilities for administering elections.
Neither side should be allowed to ignore the law simply because it believes its political position is correct.
What concerns me is the possibility that election security becomes another excuse for government agencies to demand enormous amounts of personal information or exercise authority without sufficient oversight.
I support voter identification, citizenship verification, accurate voter rolls, and meaningful penalties for proven election fraud.
But those protections should be implemented through transparent, lawful procedures that respect the rights of eligible voters.
Election integrity cannot mean trusting every government allegation without examining the evidence.
If California is failing to enforce federal election laws, the courts should address that failure.
If federal investigators are relying on inaccurate information or demanding powers they do not legally possess, the courts should address that too.
The same constitutional standards must apply regardless of which party controls Washington or California.
Strong election security and strong civil liberties are not enemies. They are both necessary to preserve our constitutional republic.

The Ballot Must Be Protected from Both Threats
The federal courts now face an urgent dispute over how election officials should handle ballots associated with voters whose citizenship has been questioned.
The outcome could influence future federal efforts to verify voter eligibility and determine how much authority Washington can exercise over state election procedures.
What remains unresolved is whether the government’s evidence justifies the requested restrictions and whether those restrictions can be implemented without interfering with lawful votes.
Americans deserve elections that are secure, transparent, and constitutionally administered.
Verify eligibility. Protect lawful voters. Investigate credible fraud. Respect constitutional limits.
Because election integrity is not simply about preventing an illegal vote.
It is also about making certain that every eligible citizen’s lawful vote counts.
We don’t just go right. We go constitutionally right.
That’s how we #GoRight.
