A federal judge has ruled that the Justice Department’s nationwide effort to collect state voter-registration records, check them against federal immigration databases and direct states to remove suspected ineligible voters exceeded its legal authority.
The ruling addresses a significant question about American elections: How far can Washington go in verifying voter eligibility before it crosses the legal boundaries separating federal enforcement from state election administration?
The decision comes as North Carolina conducts its own citizenship-verification program, making the distinction between federal and state authority particularly relevant to voters across the state.

Washington’s Voter-Roll Plan Hits a Legal Barrier
U.S. District Judge Sparkle Sooknanan ruled against a Justice Department initiative that sought complete, unredacted voter-registration records from states.
The department planned to compare those records with federal citizenship and immigration information, including the Systematic Alien Verification for Entitlements database, known as SAVE.
The Trump administration maintains that federal agencies have authority to obtain voter-registration information to investigate potential violations of election laws and identify individuals who are not legally eligible to vote.
In a formal legal opinion, the Justice Department’s Office of Legal Counsel argued that the Civil Rights Division could obtain statewide voter lists and share them with the Department of Homeland Security for eligibility verification.
Judge Sooknanan disagreed.
In a 78-page ruling, she concluded that federal voting-rights laws did not authorize the department’s proposed nationwide voter-roll review and removal program. The court also found violations of the Administrative Procedure Act and the Privacy Act.
According to Reuters, the Justice Department requested unredacted registration records from nearly every state. Eighteen states, most led by Republicans, provided information.
The department also filed lawsuits against states that refused to comply. Reuters reported that federal judges had ruled against the department in 26 of those cases.
The court also addressed concerns about the accuracy of federal citizenship information.
SAVE records can sometimes identify naturalized American citizens as potential noncitizens because underlying government records may not reflect their updated citizenship status.
That distinction matters because a database match indicating possible ineligibility is not the same as a verified finding that someone is unlawfully registered.
The Justice Department says its efforts are intended to protect election integrity. Voting-rights organizations argue that broad federal data collection and inaccurate matches could threaten voter privacy and improperly remove eligible citizens.
Whether the administration will appeal, and how appellate courts might resolve the dispute, remains uncertain.

What This Means for North Carolina
North Carolina has already established its own program for checking voter-registration records against SAVE.
State election officials previously identified 1,599 registrations as potentially belonging to noncitizens.
That number does not mean 1,599 people have been proven to be unlawfully registered or to have voted illegally.
The North Carolina State Board of Elections has said additional verification is necessary before determining whether individual registrations are ineligible.
Carolina Journal reported that the board planned to send letters to those identified individuals, providing an opportunity to address questions about their citizenship status.
There is an important legal distinction between the two programs.
The new federal ruling concerns the Justice Department’s authority to obtain state voter records and direct voter-roll changes.
North Carolina’s program involves state election officials conducting eligibility checks under state and federal election laws.
The Supreme Court has separately paused a lower-court restriction on the expanded SAVE database. The new district court ruling does not automatically invalidate North Carolina’s separate voter-list maintenance program.

The first is voter eligibility.
American election laws establish citizenship requirements, and state election officials have responsibilities to maintain accurate registration records.
North Carolina’s election board acknowledges that noncitizens have appeared on voter rolls, including documented instances of ineligible voting.
At the same time, the board says its evidence does not suggest that noncitizen registration and voting are widespread problems.
The second question is government authority.
The Constitution assigns states primary responsibility for administering elections, while Congress possesses specific authority to regulate federal elections and protect voting rights.
Federal agencies also have enforcement responsibilities established by Congress.
The disagreement in this case concerns whether the Justice Department’s existing statutory powers extend to collecting comprehensive state voter records and directing states to remove registrations identified through federal database comparisons.
That is a question about the limits of federal authority, not simply whether election records should be accurate.
The distinction between a potential database match and confirmed ineligibility is equally important.
Naturalized citizens possess the same voting rights as other eligible American citizens. Errors in government records can create disputes over eligibility even when a person has legally obtained citizenship.
The practical questions are whether verification procedures identify ineligible registrations accurately, protect personal information and provide lawful opportunities to correct mistakes.
Those standards matter regardless of which political party controls the Justice Department or state election boards.

The Next Decision Matters
The federal court has ruled against the Justice Department’s nationwide voter-roll collection and review program.
The administration maintains that stronger citizenship verification is necessary for election integrity, while the court concluded that the particular federal process exceeded the department’s statutory authority.
North Carolina’s separate verification effort remains an important distinction, particularly because state officials have identified potential eligibility questions that have not yet been conclusively resolved.
