The Pennsylvania Supreme Court ruled it is unconstitutional for the state to accept mail-in ballots that are incorrectly dated – overturning the acting Secretary of State’s decision to include the ballots in the final count of the 2022 midterm elections.

The details: The court ruled that the county board of elections must omit mail-in ballots that are either un-dated or incorrectly dated – and the ballots must not be part of the final vote tally.

RNC Chairwoman Ronna McDaniel reacted to the court order, saying:

“Republicans went to court. Now Democrats have to follow the law.”

Back up: This issue centers around Pennsylvania’s far-left acting Secretary of State Leigh Chapman, who decided the state would accept the invalid ballots.

Here’s a quick timeline:

🗓️ May 2022: The Third Circuit Court of Appeals ruled that un-dated mail ballots must be counted.

🗓️ October 11, 2022: The United States Supreme Court ruled that the Third Circuit court decision be thrown out.

🗓️ October 12, 2022: Chapman claimed the Supreme Court ruling “does not affect the prior decision” and ordered the county board of elections to continue counting the invalid ballots.

Then the Pennsylvania Supreme Court stepped in:

The court ruled that the county board of elections is “ORDERED” to refrain from counting ballots “that are contained in undated or incorrectly dated outer envelopes.”

Big picture: This is a huge win. But the fight isn’t over. Now we need to get out and vote. We need to elect Doug Mastriano for Governor. We need to elect Dr. Oz to the Senate. Pennsylvanians, get out and vote!
