Former President Donald Trump has asked the Supreme Court to step into his dispute with the Department of Justice [DOJ] in regards to the FBI’s unprecedented August raid on his home.

Let’s set the table:

The whole dispute we’re about to dive into centers around roughly 103 pages of allegedly classified documents that the FBI seized during their raid on Trump’s home.

The Biden DOJ wants access to them right away.

Trump wants the court-appointed ‘Special Master’ to review them first.

Remember:

In mid-September, District Court Judge Aileen Cannon appointed a ‘Special Master’ to sift through the materials seized from Trump’s home and make sure there was nothing taken that the FBI didn’t have a warrant to take.

The DOJ asked Judge Cannon to exclude the 103 pages of classified documents from the Special Master’s review.

She denied them.

On September 21, a U.S. Court of Appeals for the 11th Circuit overruled Judge Cannon and said the DOJ could take those 103 pages and have them excluded from the Special Master’s review.

What Trump asked the Supreme Court to do:

Trump submitted an emergency request, asking them to lift the 11th Circuit court’s order.

His filing says:

“The Government has attempted to criminalize a document management dispute and now vehemently objects to a transparent process that provides much-needed oversight.”

Trump card:

Since this dispute is taking place under the 11th Circuit’s jurisdiction, it goes directly to the Supreme Court Justice who oversees that circuit…

Justice Clarence Thomas.

What happens next: Justice Thomas has requested the DOJ respond to Trump’s petition by 5 PM on October 11.
