The Fight Over North Carolina’s Elections Is Far from Over
A major constitutional battle over who controls elections in North Carolina is heading back toward the state’s highest court.
Democratic Governor Josh Stein has filed a petition asking the North Carolina Supreme Court to overturn a ruling that allowed Republican State Auditor Dave Boliek to control appointments to state and county elections boards.
The dispute goes beyond which political party holds power. It raises a fundamental constitutional question: Can lawmakers transfer executive responsibilities between elected officials, or does doing so undermine the separation of powers?
With North Carolina’s elections approaching, the outcome could shape how the state administers future elections and how much authority the General Assembly has over the executive branch.

The Power Shift Behind the Ballot
The controversy began with Senate Bill 382, enacted in 2024 over then-Governor Roy Cooper’s veto.
The legislation transferred authority over appointments to the State Board of Elections and county elections boards from the governor to the state auditor.
Boliek subsequently used that authority to appoint new members, shifting the state elections board and all 100 county boards from Democratic to Republican majorities.
A three-judge trial court initially ruled against the transfer. However, the North Carolina Court of Appeals reversed that decision in a 2-1 ruling, concluding that lawmakers had not clearly violated the state’s constitutional separation of powers.
The majority reasoned that the legislature transferred responsibilities to another independently elected executive official rather than taking direct control of election administration itself.
The dissent argued that removing election oversight from the governor interfered with powers assigned to that office under the state constitution. FindLaw
Stein’s latest petition asks the North Carolina Supreme Court to review that decision.
His attorneys argue that allowing lawmakers to redistribute executive responsibilities without meaningful constitutional limits could undermine the authority voters assigned to particular elected offices.
Boliek and Republican legislative leaders maintain that the General Assembly has constitutional authority to assign statutory duties among members of the Council of State.
Boliek has also defended the current system, saying his objective is impartial, secure, and effective election administration.
For now, the existing appointments remain in place. The Supreme Court has not overturned the appellate ruling, and the governor’s latest petition does not establish that the law is unconstitutional.
The legal question remains unresolved, and the court’s next decision could determine how North Carolina distributes election oversight authority. Carolina Journal

Election Integrity Cannot Become a Political Prize
The Go Right with Peter Boykin Perspective
First of all, I support President Donald Trump, and I believe Republicans are right to demand secure elections, accurate voter rolls, and accountability from election officials.
But being a Constitutionalist for Liberty means defending constitutional limits even when Republicans benefit from a particular government action.
I support legitimate efforts to strengthen election integrity. I also believe North Carolina’s General Assembly has an important constitutional role in establishing election laws.
However, the legislature’s authority is not unlimited.
The governor does not own our elections. Neither does the state auditor, the General Assembly, or any political party.
Elections belong to the people, not the politicians administering them.
North Carolina has an unusual executive structure, with multiple independently elected statewide officials. That makes this constitutional dispute more complicated than simply arguing that the governor must control everything.
If the Constitution permits lawmakers to assign election-related responsibilities to the auditor, the courts should uphold that authority.
If the transfer violates constitutional limits, the courts should say so.
What concerns me is the possibility of election administration becoming a political football, with responsibilities repeatedly reassigned depending on which party controls the legislature.
That would undermine public confidence regardless of whether Republicans or Democrats benefited.
I want secure voter identification, accurate citizenship verification, transparent election procedures, and meaningful accountability.
I also want election officials who follow the law rather than political instructions.
The standard should be constitutional authority, not partisan advantage.
That is how we protect election integrity without sacrificing constitutional government.

The Constitution Must Set the Rules
North Carolina’s Supreme Court now faces a request to examine one of the state’s most consequential disputes over election administration.
The immediate question is whether the justices will review the appellate ruling. The larger question is how much freedom lawmakers have to redistribute authority within the executive branch.
The outcome could affect election oversight long after the current political leadership leaves office.
Secure elections. Clear constitutional boundaries. Accountable government. One standard for every political party.
Because election integrity means more than counting ballots correctly. It also means ensuring that the people administering those elections exercise only the authority the law permits.
We don’t just go right. We go constitutionally right.
That’s how we #GoRight.
