A.I. Music Startup Suno Fires Back at Record Labels, Admits Training on Copyrighted Music

In a legal clash that highlights the evolving landscape of music and technology, AI music startup Suno is defending its use of copyrighted music to train its AI models against accusations from major record labels. These labels, representing a significant portion of the music industry, have accused Suno and other AI music startups like Udio of infringing on copyrights. The central argument revolves around the fair use doctrine and the broader implications for innovation and competition within the music industry.

The record labels’ lawsuits allege that Suno and Udio have been “trampling the rights of copyright owners” by using copyrighted music to train their AI models without permission. In response, Suno has acknowledged that its music-generating model was indeed trained on copyrighted music. However, the startup insists that this practice is legal under the fair use doctrine.

Suno’s attorneys argue that the real issue at hand is competition. They state, “What the major record labels really don’t want is competition. Where Suno sees musicians, teachers, and everyday people using a new tool to create original music, the labels see a threat to their market share.” This perspective underscores a belief that the lawsuits are an attempt by the labels to maintain their dominance in the industry.

Suno’s AI technology allows users to create songs by simply typing descriptions and can also expand upon uploaded sound files. The company’s legal filing reveals that its neural network was trained on “tens of millions” of recordings available on the “open Web,” which includes copyrighted songs available on platforms like YouTube. “It is no secret,” the filing states, “that the tens of millions of recordings that Suno’s model was trained on presumably included recordings whose rights are owned by the Plaintiffs in this case.”

The record labels, in their lawsuit, do not claim that the songs generated by Suno directly violate copyrights. Instead, they focus on the training process. The labels’ attorneys argue, “Foundational principles of copyright law dictate that copying protected sound recordings for the purpose of developing an AI product requires permission from rightsholders. Suno cannot avoid liability for its willful copyright infringement by claiming fair use. The doctrine of fair use promotes human expression by permitting the unlicensed use of copyrighted works in certain, limited circumstances, but Suno offers imitative machine-generated music — not human creativity or expression.”

In rebuttal, Suno’s lawyers call the labels’ argument “confusing” and assert that focusing on the training process will undermine the plaintiffs’ claims. They argue that it is fair use under copyright law to make a copy of a protected work as part of a back-end technological process if it results in a non-infringing new product. Suno’s response emphasizes, “In the 233 years since the first copyright law in this country was enacted, no case has ever— not one single time — reached a contrary conclusion…. The outputs generated by Suno are new sounds, informed precisely by the ‘styles, arrangements and tones’ of previous ones. They are per se lawful.”

Suno also accuses the labels of “misuse of copyright” to suppress competition and believes they can win the case on these grounds alone. “With the benefit of discovery, Suno will show that even setting the fair use issue aside, Plaintiffs’ pervasive copyright misuse bars their claims altogether,” the response states.

In a blog post accompanying the legal filing, Suno argues that its model learns from previous music similarly to how human musicians do. The post also criticizes the timing of the lawsuit, noting that Suno had been in discussions with major labels about “expanding the pie for music together.” The company states, “We did so not because we had to, but because we believe that the music industry could help us lead this expansion of opportunity for everyone, rather than resisting it. Whether this lawsuit is the result of over-eager lawyers throwing their weight around, or a conscious strategy to gain leverage in our commercial discussions, we believe that this lawsuit is an unnecessary impediment to a larger and more valuable future for music.”

The broader debate over the use of training data for generative AI models continues. Similar legal battles, such as The New York Times suing OpenAI, highlight the ongoing tensions between technological innovation and traditional copyright protections.
