Federal Court Rules DC prosecuted pro-lifers while ignoring BLM rioters
A federal appeals court has concluded that Washington D.C.’s application of its “defacement” laws exhibited inconsistencies by apprehending two pro-life advocates while overlooking the actions of numerous BLM protestors during the summer of 2020.
The “defacement” law in Washington D.C. is designed to prevent the destruction or defacement of public or private property, encompassing acts such as graffiti and unauthorized marking of surfaces.
Instances of Selective Enforcement arose during the summer of 2020 when a significant number of BLM demonstrators congregated in the streets of D.C., adorning surfaces with paint and chalk. Despite these activities, only four individuals faced arrest for violating the city’s defacement law.
In contrast, during the same period, a smaller-scale pro-life protest took place, during which D.C. Metro Police detained two pro-life advocates for inscribing “black pre-born lives matter” on a sidewalk using chalk.
Legal actions were initiated as a result of these arrests, as conservative organizations including the Frederick Douglas Foundation and Students for Life of America filed lawsuits against the city, alleging a breach of their constitutional rights due to unequal enforcement.
In its verdict, the federal appeals court overturned a prior ruling by a lower court, which had dismissed the case. The court asserted, “Government authorities must administer laws without bias, ensuring equitable treatment within public discourse.”
As a consequence of this reversal, the case will now proceed accordingly.
