A Lesson in Accountability or a Slippery Slope?
Picture this: A responsible North Carolina gun owner, lawfully exercising his Second Amendment rights, secures his firearm in his home. One day, unbeknownst to him, a thief breaks in, steals the weapon, and later uses it in a crime. The crime is tragic, the loss of life devastating. But here’s the question: Should the gun owner, the victim of theft, now be held accountable for the actions of the criminal who stole the firearm? That is precisely the debate raging in North Carolina’s General Assembly as lawmakers push for the Jenesis Firearm Accountability Act.
A new bill introduced in the North Carolina Senate aims to impose stricter reporting requirements on gun owners whose firearms are lost or stolen. Named after 8-year-old Jenesis Dockery, who was tragically killed in Fayetteville in 2023, Senate Bill 161 would require gun owners to report their lost or stolen firearms within 48 hours or face penalties.
If a stolen gun is later used in a crime, the original owner would receive a warning for the first offense. However, repeat violations would lead to fines of up to $500 for a second offense and $1,000 for additional infractions. In extreme cases where the stolen gun is used in a violent felony or misdemeanor, the bill proposes holding the original gun owner criminally responsible, equating their charges to those of the criminal who committed the offense—unless the owner can demonstrate a “reasonable inability” to report the theft in time.
Senator Val Applewright (D-Cumberland), the bill’s sponsor, called the proposal a “no-brainer,” arguing that it’s a necessary measure to promote responsible gun ownership.
But not everyone sees this as a simple measure for safety. Many gun rights advocates argue that the bill is a dangerous precedent that unfairly punishes law-abiding citizens for crimes committed by others.
Former Greensboro Police Officer Marc Ridgill pointed out a key flaw in the bill’s enforcement: matching a stolen gun to its original owner isn’t as straightforward as it seems.
“There are guns with the same serial numbers. You can have, say, a Ruger, a Colt, or a Sig Sauer pistol. They could all three have the exact same serial number.”
Additionally, private gun sales make tracing firearm ownership nearly impossible, as North Carolina does not require firearm registration.
“People sell guns to other people all the time. It’s not like you have a car registration or a title that you go to the DMV and sign over,” Ridgill said.
Critics also argue that this legislation creates a dangerous legal precedent—if gun owners can be held responsible for crimes committed with their stolen property, what’s next? Should car owners be held responsible if their stolen vehicle is used in a hit-and-run? Should alcohol manufacturers be sued when a drunk driver causes an accident?
If the logic behind this bill is extended to other industries, it could open Pandora’s Box for liability lawsuits. Imagine a scenario where a car is stolen, and the thief causes a deadly accident—should the car’s legal owner be charged for vehicular manslaughter? Or what if an intoxicated driver causes a crash—should car manufacturers, dealerships, or even bartenders be held responsible for the actions of the drunk driver? By this logic, auto manufacturers could be sued for reckless driving, and knife manufacturers could be held accountable for stabbings. This sets a dangerous precedent, shifting blame from criminals to innocent citizens.
This is not a far-fetched scenario. If gun manufacturers and legal gun owners can be held liable for crimes committed by third parties, the same logic could be used to hold technology companies accountable for cybercrimes committed using their devices or hold banks responsible for fraud committed by their customers. The shift in accountability from the perpetrator to third parties is a significant departure from long-standing legal principles.
For Fon Dockery, Jenesis’ father, this bill is not about politics—it’s about preventing future tragedies. He has been working with lawmakers to push for the bill’s passage for over a year, despite his mixed emotions about seeing his daughter’s name attached to legislation.
“We just know we’re hurt, and we want to do something powerful with that hurt,” Fon said.
While Dockery insists the bill is not an attack on the Second Amendment, gun rights advocates remain skeptical.
Gun rights activists argue that this bill is yet another encroachment on the Second Amendment, which explicitly states that the right to own and bear arms shall not be infringed. By placing the burden on lawful gun owners rather than criminals, critics say the government is creating an environment where self-defense rights are slowly eroded under the guise of safety regulations.
In North Carolina, the open carry law allows individuals who are 18 years or older and not otherwise prohibited from possessing a firearm to openly carry a handgun. However, there are restrictions on open carry in certain places, such as schools, government buildings, and during parades or demonstrations. Local governments may also impose additional regulations on open carry in public areas.
Despite these regulations, North Carolina is generally considered a gun-friendly state, with both state and federal laws protecting the right to bear arms. In fact, the state is currently on the verge of passing permit less carry, which would allow individuals 18 and older to carry a concealed weapon without a permit. This move, supported by many Second Amendment advocates, stands in stark contrast to the proposed Jenesis Firearm Accountability Act, which many view as a step in the opposite direction toward more government control.
The Jenesis Firearm Accountability Act raises broader concerns about the erosion of personal liberties and government overreach. This bill, though well-intentioned, shifts responsibility from the criminal to the victim—punishing lawful gun owners instead of addressing the root cause of crime.
Moreover, there is no clear evidence that such a law would prevent crime. Criminals, by definition, do not follow the law. Stricter penalties on law-abiding citizens do little to deter those who steal firearms with the intent to use them in violent acts.
If the government can hold an innocent victim accountable for the actions of a thief, where does it stop?
The bill has passed its first reading in the Senate and is now in committee. If it advances, it will require three readings in the House before reaching the governor’s desk. As the debate rages on, North Carolinians must decide whether this legislation is a step toward safety or a step toward criminalizing victims in the name of accountability.
