A federal judge in Florida ended Joe Biden’s federal travel mask mandate, saying the Biden regime and the CDC overstepped their constitutional power.

The ruling: U.S. District Judge Kathryn Kimball Mizelle, a Trump-appointed judge who clerked for Justice Clarence Thomas, ruled that:

“The Mandate exceeded the CDC’s statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions.”

“Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the Court declares unlawful and vacates the Mask Mandate.”

Back up: On his second day in office, Joe Biden signed an executive order requesting the CDC rule for planes, trains, ride-sharing (Uber), and other forms of public transit.

Since his initial order, the Biden regime has extended the mandate every time it was set to expire – four times.

So far all the major U.S. airlines have issued statements declaring their mask requirements lifted. Amtrak trains and Uber ridesharing have also announced they’ve lifted mask mandates.

What happens next? It’s possible that the Biden regime challenges this ruling. White House Press Secretary Jen Psaki told reporters:

“This is obviously a disappointing decision… the Department of Justice will make any determination about litigation.”

The overwhelming reaction has been positive.

If the Biden regime fights this, it’s going to drive more voters away from the Democrat party at a time where they’re already bleeding support.
