North Carolina GOP Says, “Equality for All” Then Defends a Ban on Gay Marriage

The North Carolina Republican Party says it “encourages equality for all citizens.” Its current platform also calls government’s fundamental role the protection of individual rights.

Then the platform reaches marriage.

There, the party declares that marriage between one man and one woman is the foundation of civil society, calls for marriage law to be returned to the states, supports North Carolina’s marriage amendment, and encourages efforts to defend it.

That is not an old webpage accidentally left online. As of August 15, 2026, the NCGOP’s official Party Platform page still publishes the 2025 platform, whose Article I contains that position.

For gay conservatives, libertarians, and constitutionalists, the contradiction is impossible to miss: a party can defend churches from state coercion, protect parental rights, reject ideological excesses in schools, and preserve women’s sports without asking government to treat a gay couple’s civil marriage as legally inferior.

What Changed in the Platform? Almost Nothing

The material story is continuity.

The 2023 NCGOP platform used substantially the same language. In 2025, the family section was reorganized, but its marriage policy did not soften: one-man/one-woman marriage remains the preferred legal model, and the party still endorses defending the state constitutional amendment.

That puts North Carolina to the right of the 2024 national Republican platform. The national document says Republicans will promote a culture that values the “sanctity of marriage,” but it does not expressly define marriage as one man and one woman or call for overturning Obergefell v. Hodges.

In other words, the national party created room for a broader coalition. North Carolina’s party has not followed.

The Bans Are Dormant, but Still Written into State Law

North Carolina’s constitution still says that marriage between one man and one woman is the only domestic legal union the state may recognize. General Statute 51-1.2 still declares marriages between people of the same sex invalid in North Carolina.

Neither provision is enforceable today. The Supreme Court’s 2015 decision in Obergefell requires states to license and recognize same-sex marriages. The Court left that precedent in place again on November 10, 2025, when it declined to hear Kim Davis’s petition seeking to challenge it.

But “unenforceable today” is not the same as repealed.

If Obergefell were ever overturned, North Carolina’s old language could become consequential again. The federal Respect for Marriage Act would still require North Carolina to recognize a same-sex marriage validly performed in another state, and the federal government would still recognize that marriage. The act does not, however, independently require North Carolina to issue same-sex marriage licenses inside the state if the constitutional rule in Obergefell disappears.

That is why the platform plank is not merely symbolic. It endorses keeping a legal switch in place while urging the party to defend it.

North Carolina Had a Chance to Clean Up the Law

Lawmakers introduced two relevant bills in February 2025.

House Bill 174, the Marriage Equality Act, would repeal G.S. 51-1.2, codify equal civil marriage, and bar officials from refusing licenses or civil ceremonies based on the couple’s sex, gender, or sexual orientation. It would also repeal the state’s existing religious-recusal statute.

House Bill 175 would let voters remove the one-man/one-woman provision from the North Carolina Constitution.

Both bills passed a first reading and were sent to the House Rules Committee on February 25, 2025. The General Assembly’s official pages show no later action and no recorded vote as of August 15, 2026. The proposed November 2026 referendum in H175 therefore did not reach the ballot through that bill.

The stalemate leaves North Carolina with an odd arrangement: gay couples can marry under controlling federal law, while the state constitution, a state statute, and the governing party’s platform all say their marriages should not count.

Religious Liberty and Civil Equality Can Coexist

Supporters of the NCGOP plank often frame the issue as a defense of religious freedom. Religious freedom deserves a vigorous defense—but civil marriage licenses are government instruments, not church sacraments.

North Carolina already recognizes that distinction. G.S. 51-5.5 permits magistrates and certain register-of-deeds employees to recuse from all marriage duties because of a sincerely held religious objection. At the same time, the law requires officials to ensure that qualified couples can still receive licenses and civil ceremonies.

Federal law also protects conscience. The Respect for Marriage Act preserves existing religious-liberty protections and says nonprofit religious organizations cannot be forced to provide goods, services, or facilities for the solemnization or celebration of a marriage.

That is the constitutional balance worth defending: churches decide which marriages they bless; government treats citizens equally under civil law.

Keep the Conscience Shield. Drop the Government Ban.

North Carolina Republicans do not have to choose between religious liberty and gay Americans. That is a false choice, and it is politically self-defeating.

The NCGOP should remove the plank endorsing the marriage amendment at its next platform convention. The General Assembly should repeal G.S. 51-1.2 and send voters a clean amendment removing Article XIV, Section 6 from the state constitution.

At the same time, legislators should preserve a workable conscience protection for religious objectors, provided the government guarantees every qualified couple prompt and equal access to a license and civil ceremony. H174’s decision to pair marriage equality with repeal of the entire recusal statute makes an unnecessary fight.

Split the issues. Repeal the government ban; keep a narrow conscience shield that cannot be used to deny public service.

Republicans can still debate school curricula, parental authority, women’s sports, medical policy for minors, compelled speech, and the reach of anti-discrimination law. Those are separate questions. None requires the state to treat two law-abiding gay adults as strangers when they form a household, assume obligations, raise children, care for one another, or plan an estate.

For Gays For Liberty, this is not a demand that churches rewrite doctrine or that conservatives adopt the entire progressive LGBTQ agenda. It is a demand for limited government, equal civil treatment, and freedom of conscience for everyone.

For Gay Right News, the political warning is equally clear: platforms are recruiting documents. Telling gay Republicans that they are welcome while promising to defend a legal ban on their marriages is not coalition building. It is a mixed message written into party policy.

A confident conservative movement should be able to protect the pulpit without controlling the courthouse. North Carolina Republicans should prove it.
