North Carolina Power Struggle Affects the People Not Just Politicians

Imagine a small business owner in North Carolina, working tirelessly to recover from the devastation of Hurricane Helene. He’s trying to rebuild, seeking financial assistance, and hoping that the government he pays taxes to will prioritize his needs. Meanwhile, behind closed doors in Raleigh, lawmakers are locked in a battle—not about disaster relief, but about who holds the reins of power in our Constitutional Republic. As always, it seems the real losers in these political struggles are not the politicians but the everyday citizens who rely on effective governance.

This is what’s happening right now in North Carolina, where Republican legislators have overridden a veto from former Governor Roy Cooper to pass a sweeping bill that significantly reduces the power of the current Democratic administration under Governor Josh Stein and other statewide officials. This move has ignited protests, drawn national attention, and raised serious questions about the balance of power in our government.

Government & Elections

North Carolina Republicans Override Veto to Shift Power in Government

North Carolina’s Republican-controlled legislature has successfully overridden a veto from former Democratic Governor Roy Cooper, enacting a law that shifts significant executive power away from the governor’s office and other elected Democratic officials. This legislation is not just about internal political maneuvering—it fundamentally alters how the state operates and administers elections.

Among the most controversial changes is the transfer of the power to appoint members of the State Board of Elections from the governor to the state auditor, a position currently held by a Republican. Historically, the governor’s party has held a majority on the board, but under this new law, Republicans will likely dominate both the state and county election boards.

This move follows a long history of partisan power struggles in North Carolina. When Republican Pat McCrory was governor, Democratic lawmakers curtailed his powers. Now, with a Democratic governor, Republicans are taking their turn at reshaping authority. The real question is whether this cycle of stripping powers truly serves the people or merely keeps the political pendulum swinging.

Checks and Balances or a Slippery Slope?

One of the major criticisms of this legislation is that it weakens the balance of power in North Carolina’s government. The governor’s ability to fill vacancies on the state Supreme Court and Court of Appeals has been reduced, and the attorney general will now be prohibited from taking legal stances contrary to the legislature’s position.

This raises an important Constitutional question: Is this a justified legislative check on executive power, or does it erode the core principles of our Constitutional Republic? If the roles were reversed, would Republicans want a Democratic legislature stripping a Republican governor of these powers? This tit-for-tat approach to governance does not create stability—it only intensifies political gridlock.

The attorney general, a role now filled by Democrat Jeff Jackson, will also see major limitations. The new law prevents him from intervening in legal challenges to state laws or taking legal positions that conflict with the General Assembly’s stance. In other words, the state’s top legal officer will be bound to the political will of the legislature rather than serving as an independent legal authority.

Additionally, a specific provision extends the term of the current State Highway Patrol commander, Col. Freddy Johnson, until 2030, preventing Governor Stein from appointing his own commander during his term.

Republicans argue that these changes align with their constitutional rights as lawmakers. “The state constitution gives this body the ability to make certain decisions,” said Rep. Destin Hall, who is poised to become Speaker of the House. However, critics argue that tying the hands of the executive branch undermines the checks and balances that keep government accountable.

Disaster Relief and Political Football

Hurricane Helene Recovery Tied to Political Battles

One of the most contentious aspects of this bill is its inclusion of Hurricane Helene disaster relief funding. The bill earmarks $252 million for recovery efforts in western North Carolina, an area devastated by historic flooding. However, much of this money cannot be spent until the General Assembly takes further action, leaving storm victims in a state of uncertainty.

Democratic lawmakers and Governor Stein have accused Republicans of using disaster relief as a political tool to mask an unconstitutional power grab. “It is despicable for the Republicans in the General Assembly to use folks’ incredible need for aid to cloak their political pettiness,” said Governor Stein.

Republicans counter that they have already allocated over $900 million for relief and intend to provide more in the future. However, the immediate need remains, and many small businesses and families are still waiting for direct assistance. The debate over how and when funds will be distributed only adds to the frustration of those affected.

Voting and Election Law Changes

New Election Rules Under Scrutiny

The new law also alters election rules, changing deadlines for counting absentee and provisional ballots. Republicans argue that this change is necessary to ensure timely election results and prevent delays in determining winners. However, Democrats argue that this could disenfranchise voters, particularly in close races where every ballot matters.

Additionally, a proposed constitutional amendment will be placed on the 2026 ballot, requiring all North Carolina voters to show photo identification before voting. While voter ID laws have been a longstanding Republican priority, they remain a point of contention, with critics arguing that they disproportionately impact minority and low-income voters.

Legal Challenges and Broader Implications

Governor Stein and Attorney General Jeff Jackson have filed a lawsuit challenging the constitutionality of this law, arguing that it violates the separation of powers outlined in the North Carolina Constitution. This legal battle could set a significant precedent for the distribution of power between state legislatures and executive offices across the country.

Historically, similar moves have been observed in other states where legislatures have sought to limit the authority of incoming officials from opposing parties. Critics argue that such moves undermine democratic principles, while supporters contend they are necessary to maintain checks and balances.

#GoRight Recap

North Carolina Republicans have passed a sweeping law that reduces the power of incoming Democratic officials, overrides a gubernatorial veto, and restructures key governmental functions. This includes changes to election oversight, judicial appointments, and the attorney general’s legal authority. The law is already facing legal challenges, and its long-term impact remains uncertain.

Final Thoughts and Call to Action

Power struggles in government are nothing new, but at what cost do these battles come to the citizens of North Carolina? Is this a necessary legislative check, or a partisan move that undermines our Constitutional Republic’s system of checks and balances? The people deserve a government that works for them, not one that is constantly engaged in political warfare.
