Federal prosecutors are urging a six-month prison term for Ray Epps, a central figure in the January 6 U.S. Capitol breach, as they file recommendations for his sentencing. The 62-year-old Epps, a former U.S. Marine and ex-Oath Keeper, has faced speculation about his potential role as a federal informant, fueling controversy around his actions during the Capitol unrest in 2021.
The government’s filing in Washington, D.C., seeks the “high end of the applicable guidelines range,” proposing a six-month incarceration, one year of supervised release, and a $500 restitution for Epps, who recently pleaded guilty to a misdemeanor charge of disorderly or disruptive conduct in a restricted building or grounds. The sentencing is scheduled for the coming Tuesday.
Prosecutors assert that such a sentence serves to protect the community, instill respect for the law, and deter future crimes, emphasizing Epps’ acceptance of responsibility, efforts to deescalate conflicts during the riot, and cooperation with the FBI and Congress. They acknowledge his role in encouraging individuals to march to the Capitol, participating in the breach, and engaging in aggressive conduct, even if he did not physically confront law enforcement or enter the building.
The 29-page filing highlights at least five instances where Epps sought to deescalate conflicts between rioters and police officers, his voluntary cooperation with the FBI and Congress, and what prosecutors perceive as genuine remorse for his actions and the broader impact on democracy. They also reference the defamation lawsuit Epps filed against Fox News, challenging claims that he acted as a federal agent on January 6.
The Department of Justice, marking 35 months since the Capitol breach, has reported over 1,237 defendants charged across the country in connection to the incident. Numerous guilty pleas and convictions have occurred, including four Oath Keepers found guilty of seditious conspiracy. Stewart Rhodes, the group’s founder, received an 18-year prison sentence.
Notably, former President Donald Trump, who faces his own legal challenges, including those linked to the Capitol breach, has hinted at the possibility of pardoning a significant number of January 6 defendants if granted a second term. As Epps awaits his sentencing, the fallout from the events of January 6 continues to reverberate through the legal and political landscape.
