The Supreme Court’s recent decision to review a case has ignited significant controversy surrounding the Department of Justice’s (DOJ) use of Section 1512(c)(2) of the U.S. code to charge hundreds of January 6 defendants, including former President Donald Trump.
In a pivotal move, the highest court will scrutinize whether the DOJ misapplied this legal provision in charging individuals with “obstruction” of an official proceeding, a matter that has garnered significant attention and criticism. Journalist Julie Kelly, a vocal critic of the DOJ’s handling of the January 6 cases, emphasized the intentional misinterpretation of the statute by the DOJ, signaling a potential turning point.
