A Trade Fight Becomes a Constitutional Test

President Donald Trump’s administration is facing another major legal challenge over its trade policies, this time involving a 50% tariff on certain imports from Canada.

An American food importer has filed a federal lawsuit arguing that the administration exceeded its legal authority by relying on a rarely used provision of the Tariff Act of 1930.

The dispute raises a constitutional question that reaches far beyond international trade: How much economic power can a president exercise without additional congressional authorization? Reuters

A 1930 Law Meets a Modern Court

Gellert Global Group, a family-owned food importer based in New Jersey, filed its lawsuit in the U.S. Court of International Trade.

The company challenges the administration’s use of Section 338 of the Tariff Act of 1930, a provision permitting tariffs against countries found to discriminate against American commerce.

The Trump administration argues that Canadian trade policies unfairly disadvantage American automobiles, dairy products, and alcoholic beverages. The White House maintains that Section 338 provides lawful authority to respond to those practices.

The lawsuit challenges both the scope of that authority and the procedures used to impose the tariffs.

Attorneys representing the importer argue that Congress subsequently enacted trade laws establishing more specific procedures and limitations on presidential tariff authority.

They also allege that the administration violated a statutory waiting period when it added certain Canadian cheeses to the tariff list.

The economic consequences are not limited to Canadian producers. American importers pay tariffs when goods enter the United States, and those additional costs can affect domestic businesses, suppliers, and consumers.

The Supreme Court previously rejected the administration’s use of a different federal statute to impose broad tariffs. However, that decision does not automatically invalidate tariffs imposed under Section 338.

The new lawsuit remains pending. No court has determined that these particular tariffs are unlawful. Reuters

America First Still Needs Constitutional Guardrails

The Go Right with Peter Boykin Perspective

I support President Donald Trump, and I believe protecting American industries, workers, and businesses from unfair foreign trade practices is a legitimate government responsibility.

America should not be expected to accept discriminatory trade policies while other nations restrict access to their markets.

But supporting a president does not mean abandoning the constitutional limits on presidential authority.

As a Constitutionalist for Liberty, I believe the separation of powers matters regardless of which political party controls the White House.

Congress possesses the constitutional authority to regulate commerce with foreign nations and impose duties. Congress can delegate portions of that authority to the executive branch, but those delegations come with legal boundaries.

A strong president is not the same thing as an unlimited president.

If Congress authorized these tariffs, and the administration followed the law, the courts should recognize that authority.

If the administration exceeded the authority Congress granted, the courts have a responsibility to enforce those limits.

That is not opposition to President Trump. That is support for the constitutional system every president swears to uphold.

I also believe we must examine who ultimately bears the financial burden of trade restrictions.

Protecting American manufacturing is important. So is protecting American families and businesses from unnecessary economic hardship.

Good trade policy should strengthen our economy without treating constitutional safeguards as obstacles.

We can support America First policies while insisting that government follow the law.

Those principles belong together.

Protect American Trade. Respect American Law.

This lawsuit could help determine how much authority presidents have to impose tariffs under older federal trade statutes.

The next developments will involve the court’s consideration of the importer’s request for immediate relief and the administration’s legal defense.

The outcome could affect American businesses, international trade relationships, and the limits of executive power.

Protect American workers. Challenge unfair trade. Respect congressional authority. Defend constitutional limits.

Because economic strength and constitutional government should never be competing priorities.

We don’t just go right. We go constitutionally right.

That’s how we #GoRight.
