Scalia famously said, “If it were up to me, I would put in jail every scruffy-bearded weirdo who burns the American flag. But I am not king.”

President Trump has repeatedly praised Justice Scalia and promised to appoint judges in his mold. Yet here Trump departs from Scalia’s principled defense of the First Amendment. The executive order, however, is carefully crafted to focus only on acts tied to violence or public disorder, keeping it on the edge of constitutional boundaries.

Yet in 2005, then-Senator Hillary Clinton co-sponsored the Flag Protection Act of 2005, which proposed criminal penalties, including fines and up to one year in prison, for flag burning if it was intended to intimidate or incite immediate violence. That legislation never became law, but it shows that Democrats once supported similar measures.

Now, many of the same voices denouncing Trump supported laws that would have restricted the same conduct just two decades ago.

Think about the symbolism. A veteran who once wore the uniform chose to burn the flag in defiance. A president who swore an oath to defend the Constitution chose to issue an order demanding the flag’s protection. Both men claim the title of patriot. Both lit fires, one literal and one political. Each fire forces us to confront a harder truth: is America strong enough to withstand the burn and still stand when the smoke clears?

The Constitution is clear. The Supreme Court, with justices like Antonin Scalia, ruled that flag burning is protected speech even if it offends, even if it disgusts.
