The Midterms Are Also a Fight Over Subpoena Power

Democratic lawmakers and congressional staff have been preparing investigations they could launch if their party gains control of either chamber.

Potential scrutiny could include Trump-family business ventures, administration decisions and possible conflicts of interest.

The election therefore determines more than which party passes legislation.

It determines who controls committees, hearings and congressional subpoena power.

Winning is NOT Governing

Congress absolutely has legitimate oversight authority.

That should remain true regardless of which party controls the White House.

Oversight should investigate credible government misconduct.

It should not become an endless partisan industry designed primarily to paralyze whichever administration the opposition dislikes.

Congress also has responsibilities beyond investigations.

The legislature writes laws.

It controls appropriations.

It possesses constitutional war powers.

It oversees executive agencies.

The Constitution is not an obstacle to governing.

It is the framework that distinguishes a republic from systems in which whoever controls the executive controls everything else.

Every Power You Create Today Belongs to Your Opponent Tomorrow

The real test of congressional control is not whether a party can subpoena its enemies.

It is whether Congress remembers how to legislate, oversee, budget and restrain power.

Investigate credible allegations.

Demand evidence.

Write durable laws.

Exercise the power of the purse.

And remember that every authority you create for your side eventually belongs to the other side.
