YOUR MENTAL HEALTH RECORDS NOW LEGALLY AVAILABLE FOR SALE
Thanks to the rise of online health platforms, data brokers are buying access to and selling your name, address, mental health diagnoses, prescription drug history, and much more without your knowledge. And the scary part is… it’s all legal.
The data cited below comes from a new study from Duke University’s School of Public Policy. Duke located and contacted 37 of these data brokers. Of them, 11 offered personal data.
During the Covid pandemic, we saw the rise and adoption of health apps. These ranged from telehealth virtual appointments, therapy, online pharmacies, and more. The byproduct of these app-based services has been the mass collection of your most personal health data.
The type of personal information offered was:
Identifying data: name, ethnicity, age, gender, zip code, religion, children in the home, marital status, net worth, credit score, date of birth
Medical history: depression, PTSD, attention disorder, insomnia, anxiety, ADHD, and bipolar disorder
The price for this data varied by broker. One was selling bundles of health data, starting at $275 per 5,000 contacts. Others sold year-long subscriptions for as much as $100,000.
Where do they get the data? Duke noted that the data brokers were “collectively less willing to provide access and disclosure to their customers.”
This invasion of privacy is legal: In 1996 Congress enacted the Health Insurance Portability and Accountability Act (HIPPA), meant to make sure hospitals, doctors, and other health facilities protect the privacy and security of individuals’ health information.
However… HIPPA doesn’t protect health information on mobile apps and other web companies that we hand our health data over to.
Related: Earlier in Feb 2023, online prescription drug service, GoodRx was fined $1.5 million by the Federal Trade Commission for taking user data and using it to target them with Facebook ads.
Now, with the rise of advanced search and machine learning, these tech companies disguised as health companies don’t even need you to share your diagnosis. They can monitor what health issues you’re searching for or reading about in their apps, and build a personal profile for you based on that.
