The Trump administration has suspended Microsoft and several major technology companies from a federal labor-certification program used to sponsor foreign workers for permanent residency.

Vice President JD Vance says the action addresses alleged abuse of immigration programs that are supposed to protect American workers. Microsoft disputes the administration’s characterization of its hiring practices.

The decision raises questions about American jobs, immigration enforcement, corporate accountability and how the government determines whether employers are following federal labor laws.

 

 

Washington Puts Big Tech’s Hiring Under Investigation

The administration’s action targets the Permanent Labor Certification program, commonly called PERM.

Under federal law, employers seeking permanent residency for many foreign workers must first demonstrate that qualified, willing and available American workers cannot fill the position. The Department of Labor must also determine that hiring the foreign worker will not adversely affect wages and working conditions for similarly employed Americans.

The administration announced suspensions affecting Microsoft, Adobe, Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL Technologies and Capgemini.

The action stops new PERM applications and processing of pending applications involving those employers while the suspensions remain in place.

Vance accused Microsoft of misusing the system while laying off American employees. He cited approximately 6,000 layoffs alongside thousands of H-1B visa approvals and employment-based green cards.

Those figures are part of the administration’s argument, but they do not independently establish that specific American employees were replaced unlawfully.

Microsoft responded that approximately 80% of its H-1B filings during the previous fiscal year involved extending or changing the status of existing employees. The company also said it pays H-1B employees comparably to other workers performing similar jobs.

The administration is also investigating nine universities, including Harvard, Yale and Stanford, over allegations involving exchange-visitor visas and possible misuse of federally funded research programs.

Federal investigators say subpoenas have been issued. An investigation, however, is not a finding of wrongdoing.

The suspensions affect an important step toward employment-based permanent residency. They do not automatically revoke existing H-1B visas, cancel lawful immigration status or establish that every affected application was fraudulent.

The administration has not announced a definite end date for the suspensions.

 

 

Protecting American Jobs Without Losing Due Process

I believe American immigration policy should put American workers first.

There is nothing unreasonable about expecting companies to recruit qualified Americans before using federal programs to sponsor foreign workers for permanent residency.

The PERM system already contains protections intended to prevent employers from using foreign labor to undermine American wages and employment opportunities.

If companies are violating those requirements, federal investigators should examine recruitment records, wage practices and supporting documentation.

But allegations and statistical comparisons are not the same as findings that a particular employer committed fraud.

We should be able to protect American workers without abandoning fair procedures.

There is also an important difference between temporary employment visas and permanent residency.

An H-1B visa generally allows an individual to work temporarily under specific immigration conditions. Permanent residency provides a different legal status and generally greater freedom to change employers.

Critics of the suspension argue that restricting permanent-residency sponsorship could prolong foreign workers’ dependence on their employers.

Supporters of stronger enforcement argue that certification should not proceed when there are substantial questions about whether employers have genuinely tested the American labor market.

Both arguments concern how the existing system operates.

The questions I want answered are straightforward.

What specific violations have investigators identified? Were qualified American applicants improperly rejected? Were wages misrepresented? What procedures will companies have to challenge the allegations? And what happens to workers whose applications were already pending?

Those answers will help determine whether the government’s actions are achieving their stated purpose.

America First should mean American workers receive fair opportunities, employers follow the law and immigration programs operate according to the rules Congress established.

 

 

 

American Jobs Deserve Real Accountability

The Trump administration has taken a significant enforcement step against several major technology employers, placing new and pending permanent labor-certification applications on hold.

The administration says the suspensions are intended to protect American workers and address immigration-program abuse.

Microsoft disputes important elements of the government’s claims, and the allegations have not been established as findings of wrongdoing against every affected employer.

What remains unresolved is whether investigators will establish specific violations, whether companies will challenge the suspensions and what conditions could allow processing to resume.

Protecting American jobs matters.

So does ensuring that government enforcement decisions are supported by evidence and lawful procedures.

That is how we protect workers, taxpayers and constitutional government.
