ATF Drops Major Gun Restrictions

The Trump administration has announced a major change in federal firearms enforcement, removing longstanding registration and approval requirements for suppressors, short-barreled rifles, short-barreled shotguns, and certain other firearms.
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) will no longer enforce several provisions of the National Firearms Act against these categories of weapons.
The decision follows a federal court ruling that challenged the government’s authority to maintain those requirements after Congress eliminated the associated $200 making and transfer taxes.
For Second Amendment supporters, this represents a significant reduction in federal restrictions. But the legal distinction between refusing to enforce a law and actually repealing it matters.

The $200 Tax Is Gone. Now the Registration Rules Are Falling.
The National Firearms Act of 1934 established special federal taxes, registration requirements, and approval procedures for certain firearms and accessories.
Congress subsequently reduced the making and transfer taxes on suppressors, short-barreled rifles, short-barreled shotguns, and certain other covered weapons to zero.
A federal judge in Texas ruled that the associated registration and approval provisions could no longer be justified under Congress’s taxing power as applied to those items.
Although that ruling directly protected only the plaintiffs in the case, the Justice Department decided not to appeal and instead extended its nonenforcement policy nationwide.
Under the new guidance, ATF will stop enforcing federal National Firearms Act registration and prior-approval requirements for the covered items.
However, this does not eliminate every firearms regulation.
Licensed dealers must still comply with federal background-check requirements, complete required transaction records, and follow applicable provisions of the Gun Control Act.
Machine guns and destructive devices remain subject to the National Firearms Act’s existing requirements.
State and local restrictions also remain in effect. Separate federal approval requirements still apply when transporting short-barreled rifles and shotguns across state lines.
There is another important distinction.
The administration has changed its enforcement policy, but Congress has not repealed all the underlying statutory provisions.
ATF acknowledges that future changes in federal law, court rulings, or enforcement policy could create legal complications for people possessing unregistered items.
Gun-control organizations have criticized the decision, arguing that eliminating registration requirements could weaken public-safety protections.
Supporters argue that law-abiding gun owners should not face unnecessary federal paperwork and approval requirements when the underlying tax has already been eliminated.
The immediate policy change is confirmed. Its long-term legal stability remains uncertain.

The Second Amendment Doesn’t Require a Permission Slip
The Go Right with Peter Boykin Perspective
I support the Second Amendment, and I believe government should have to justify restrictions on constitutional rights rather than automatically placing the burden on citizens.
For decades, federal firearms regulations have required Americans to navigate complicated paperwork, registration systems, taxes, and approval procedures.
When Congress eliminates a tax that helped support a regulatory structure, it is reasonable to question whether the remaining restrictions still have a valid constitutional foundation.
President Trump’s administration deserves recognition for addressing that question and reducing unnecessary federal enforcement burdens.
But there is an important constitutional principle here.
I support limited government regardless of which political party controls Washington.
The executive branch can establish enforcement priorities, but lasting legal certainty should come through legislation and constitutional court decisions, not simply an administration’s decision to stop enforcing certain provisions.
Otherwise, a future administration could reverse the policy and create serious legal uncertainty for people who relied on the government’s previous guidance.
That is not how constitutional rights should operate.
We can protect the Second Amendment while maintaining laws against violent criminals and prohibited possessors.
We can respect responsible gun ownership without pretending that every firearms regulation is automatically unconstitutional.
And we can recognize that protecting liberty requires both constitutional restraint and consistent application of the law.
A constitutional right should not depend on which president happens to occupy the White House.
That is the principle worth defending.

A Major Change, But Not the Final Word
The Trump administration’s decision represents a significant change in federal firearms enforcement and a victory for supporters of reduced government restrictions.
But the National Firearms Act has not disappeared, and important federal and state requirements remain.
The next question is whether Congress will establish permanent statutory clarity or leave gun owners dependent on enforcement policies that future administrations could change.
Protect constitutional rights. Enforce legitimate laws. Keep government within its limits.
That’s how we #GoRight.

The Trump administration has directed ATF to stop enforcing major federal registration requirements for suppressors and certain firearms. The decision represents a significant Second Amendment development, but important legal restrictions remain, and the long-term future of the policy is uncertain.
