Charges coming for Trump in Georgia
Atlanta’s leading prosecutor is preparing to charge former President Donald Trump with racketeering for his efforts to challenge the results of the 2020 election.
Georgia’s racketeering statute requires prosecutors to show a pattern of racketeering activity predicated on at least two crimes.
Fulton County District Attorney Fani Willis plans to accuse Trump of manipulating witnesses and committing computer trespassing.
Manipulating witnesses: Trump made several phone calls to Georgia election officials in the days following the 2020 election, including a call with Secretary of State Brad Raffensperger where he said “I just want to find 11,780 votes.”
Committing computer trespassing: Willis is considering charges related to ex-Trump attorney Sidney Powell allegedly breaching Dominion Voting Systems machines in Coffee Country.
‘Laughably stupid’ legal theory: Mike Davis, a former law clerk for Justice Gorsuch tweeted: “This legal theory is laughably stupid. It’s not a crime to object to elections. That’s protected by the Electoral Count Act of 1887. It’s not a crime to twist political arms. That’s protected by the First Amendment. This is Democrat law-fare. And this won’t fly with voters.”
I don’t recall a single prosecutor across America opening investigations in 2016 when Democrats conspired to convince electors to reject their oaths and not give their votes to Trump after he beat Hillary Clinton.
If Willis brings these charges, they would be Trump’s fourth indictment this year.
