North Carolina’s Anti-Trans Legislation Risks Betraying Our Constitutional Values and True Conservative Principles
In the heart of Raleigh, nearly 100 citizens recently gathered to rally against a growing wave of legislation targeting the transgender community. One of the speakers, Britt Bateman, a transgender man, expressed the frustration and pain felt by many in the LGBTQ community, stating that “Less than four months into 2025, 42 anti-trans bills have passed in 18 different states.”
The crowd had come together in response to Senate Bill 516, a new piece of legislation introduced in the North Carolina Senate. The bill aims to prohibit transgender individuals from using public restrooms that align with their gender identity and would also restrict the ability to change gender markers on official documents like driver’s licenses and birth certificates.
Let’s be clear: this isn’t about protecting anyone. It’s about restricting freedoms. And as a proud conservative and staunch constitutionalist, I say this kind of legislation is government overreach—something Republicans used to be against.
Legislative Developments in North Carolina
Civil Rights and Liberties
Senate Bill 516: This bill aims to ban transgender individuals from using restrooms corresponding to their gender identity and restricts modifications to gender markers on official documents. Critics argue that such measures not only infringe upon personal freedoms but also echo past legislative missteps that led to significant economic and reputational damage for North Carolina. The 2016 “bathroom bill” serves as a stark reminder of the potential repercussions of such policies.
Education and Parental Rights
Parents’ Bill of Rights: Enacted to enhance parental involvement in education, this law prohibits instruction on gender identity, sexual activity, or sexuality from kindergarten through fourth grade. While parental engagement is vital, the broad application of this law raises concerns about the exclusion of essential topics and the potential marginalization of LGBTQ+ students and families.
Book Bans in Schools: In alignment with the Parents’ Bill of Rights, Johnston County has initiated policies to remove books discussing gender identity and sexuality from elementary school libraries. This move, extending beyond state requirements to include fifth grade, has sparked debates about censorship and the role of educational institutions in providing comprehensive literature.
The Echoes of HB2: A Mistake Worth Remembering
This is not North Carolina’s first flirtation with discriminatory legislation. The infamous 2016 “bathroom bill” (HB2) provoked national backlash, prompted lawsuits, and cost the state over $3.76 billion in lost business investment according to an Associated Press analysis. Major corporations canceled expansion plans, concerts were scrapped, and tourism suffered—all while the state’s reputation took a massive hit.
Do we really want to repeat that mistake?
Senate Bill 516, while cloaked in language about “safety” and “fairness,” is just another government-imposed moral directive that violates the spirit of limited government and personal liberty.
The Conservative Perspective: Balancing Rights and Responsibilities
As conservatives committed to the principles of our Constitutional Republic, it is imperative to navigate these issues with a steadfast dedication to individual liberties and equal rights under the law. The Constitution serves as the bedrock of our nation, ensuring that all citizens are afforded the same protections and freedoms.
While it is reasonable to advocate for the integrity of women’s sports and the privacy of gender-specific facilities, these concerns must be addressed without infringing upon the rights of transgender individuals. Policies should be crafted to respect the dignity of all citizens, perhaps by providing alternative facilities that accommodate everyone’s needs without exclusion or discrimination.
The recent legislative efforts in North Carolina, such as Senate Bill 516 and the expansive application of the Parents’ Bill of Rights, represent a concerning trend toward governmental overreach into personal liberties. As a conservative, I firmly believe that our party must remain vigilant in upholding the Constitution’s promise of equal protection. It is not only possible but necessary to maintain our values while ensuring that the rights of LGBTQ+ individuals are not compromised.
The Republican Party has a proud history of championing individual freedoms and limiting government intrusion. We must continue this legacy by resisting policies that marginalize any group of Americans. True conservatism is about safeguarding the liberties of all citizens, recognizing that the strength of our nation lies in its diversity and commitment to justice.
My Opinion: I Am a Proud Republican, and I Stand for Real Freedom
I’ve always supported Donald J. Trump because I believe he represents the best of American exceptionalism. I never left the Trump Train—not through the smears, not through the impeachments, not through the media circus.
I stand with Trump, the leader who stood before the United Nations and called on the world to decriminalize homosexuality, demanding an end to laws that punish gay people with death or imprisonment.
I support the Trump who acknowledged marriage rights as settled law.
The Trump who told Caitlyn Jenner she could use any bathroom she wanted in Trump Tower.
The Trump who proudly held a rainbow flag on stage after the Pulse nightclub massacre and said, “I will do everything in my power to protect our LGBTQ citizens from the violence and oppression of a hateful foreign ideology.”
These moments defined the movement I helped build: Gays For Trump.
But here’s the hard truth—I had hoped the GOP would adopt the Trump of 2015-2016: the outsider who challenged the status quo and rallied around America First. That Trump threatened the entrenched political elite and shook up the establishment. But somewhere along the way, as the Swamp clawed back, I fear even Trump has been surrounded by those who don’t embody the very freedom-loving principles we supported him for.
There’s a disturbing shift happening in parts of the Republican Party—a growing influence of theocratic hardliners pushing anti-LGBTQ policies in the name of “family values.” That’s not conservative. That’s not constitutional. And it certainly isn’t American.
Supporting Trump Doesn’t Mean Blind Obedience
I still support Trump—he’s clearly the best candidate to lead our Constitutional Republic against radicals who want to destroy our freedoms. But I will not blindly follow any leader if the people around him try to hijack the conservative movement with exclusion and bigotry.
Let me be blunt: I won’t sit quietly while the Republican Party becomes a safe haven for those who reject LGBTQ Americans or use our lives as political pawns.
Yes, I agree that some accusations of transphobia or homophobia are exaggerated—especially by activists who demonize any dissent from far-left orthodoxy. But too many Republicans go beyond reasonable disagreement and outright reject LGBTQ people as if we don’t belong in this country or this party.
That is not what the Constitution stands for.
The Constitution Is for ALL of Us
Some of my fellow Republicans need to revisit the Constitution they claim to defend. You can be conservative and still support equal civil rights for LGB and T individuals. In fact, if you believe in liberty, you should.
I’ve even had to remove people from my own movement—Gays For Trump—because they’ve chosen bigotry over principle. When they attack the very freedoms they claim to defend, I call them out. And when they refuse to change, I cut them off. I’m done tolerating hypocrisy.
Being Republican should mean limited government, individual liberty, and equal justice under the law—not selective freedom for only certain Americans.
A Call to Constitutional Conservatives
Senate Bill 516, the Parents’ Bill of Rights, and the push for banning LGBTQ-themed books in schools—these efforts may win cheap applause from a narrow base, but they betray the Constitution and threaten the soul of the conservative movement.
To those who truly want to “Make America Great Again,” I say this: you cannot do that by pushing fellow Americans out of the movement. You can’t lead by fear. You must lead by freedom.
So let’s Go Right—not far-right, not theocratic-right—but Right as in right vs. wrong. Right as in Constitutional. Right as in Liberty.
