Election Security Just Became a Privacy Battle

A new federal lawsuit is challenging the Trump administration’s collection and use of voter registration information, alleging that the Department of Homeland Security is assembling a massive database containing sensitive information about millions of Americans.

The lawsuit claims federal authorities have obtained and processed voter records from at least 47 states, combining some information with commercial databases to investigate potential election fraud.

President Donald Trump’s administration has made identifying noncitizens on voter rolls a priority. That is a legitimate law enforcement objective.

But the lawsuit raises a larger constitutional question: How much personal information should the federal government collect about American voters, and what safeguards prevent that information from being misused? AP News

Millions of Records. One Major Legal Challenge.

The League of Women Voters, Electronic Privacy Information Center, and League of United Latin American Citizens filed the lawsuit in federal court in Washington, D.C.

According to the complaint, Homeland Security Investigations has processed tens of millions of voter records obtained through government and other sources.

The plaintiffs allege that the information may include names, addresses, dates of birth, driver’s license numbers, Social Security information, voting histories, and political affiliations, depending on the source.

They also claim federal authorities have supplemented voter information with commercial data and sought to integrate some records into immigration enforcement systems.

The lawsuit argues that these practices violate the Privacy Act and other federal requirements governing government information collection.

An important distinction: These are allegations in a lawsuit, not judicial findings that the administration violated federal law.

The plaintiffs cite government records supporting their account, but the full scope of the database, its safeguards, and how individual records have been used remain disputed or unclear.

The administration maintains that federal election enforcement and citizenship verification are necessary to prevent illegal voting.

Federal law prohibits noncitizens from voting in federal elections, and government agencies have legitimate authority to investigate credible violations.

However, that authority does not automatically eliminate federal privacy requirements.

The lawsuit asks the court to halt the challenged collection practices and require the deletion of information allegedly obtained unlawfully.

DHS had not provided a substantive public response to the new complaint in the initial reporting. EPIC

The controversy also matters in North Carolina.

The State Board of Elections has identified 1,392 registered voters whose citizenship information requires additional verification through the federal SAVE database.

State officials emphasize that a database flag does not prove someone is ineligible. Naturalized citizens can be incorrectly identified because government records are incomplete or outdated.

North Carolina says affected voters will not automatically lose their registrations and that any removal proceedings must follow applicable legal protections.

The state’s verification process is separate from the new lawsuit challenging DHS’s broader collection of voter information. NCSBE

Secure the Vote, not a Surveillance State

The Go Right with Peter Boykin Perspective

First of all, I support President Donald Trump. But I am here to deliver the news, not simply tell people what they want to hear.

I support citizenship verification, voter identification, accurate voter rolls, and investigating credible allegations of election fraud.

American elections should be decided by eligible American voters.

But I also believe the federal government must operate within constitutional and statutory limits.

Election integrity should never become an excuse for unlimited government surveillance.

There is a difference between checking whether someone is legally eligible to vote and building an enormous federal database containing personal information about millions of law-abiding Americans.

If government agencies need information to investigate a specific violation, they should have lawful authority, appropriate safeguards, and a legitimate purpose.

But collecting sensitive information simply because the government might someday find it useful creates serious questions about privacy and accountability.

I would oppose an unlimited voter surveillance system under a Democratic president.

I should apply that same standard under a Republican president.

The government should also explain how it protects personal information, corrects inaccurate records, and prevents legitimate voters from being wrongly targeted.

A database match is not proof of a crime.

And protecting election integrity does not require abandoning due process.

We need strong election security with strong constitutional guardrails. Not blank checks for government.

That is what being a Constitutionalist for Liberty means.

Protect the Ballot and the Citizen

The lawsuit presents another important test of federal authority over election information.

The courts must determine whether DHS’s challenged practices comply with federal privacy laws and whether the requested restrictions are justified.

The next developments will reveal how much information federal agencies have collected, what safeguards exist, and whether the government’s methods withstand judicial scrutiny.

Verify citizenship. Investigate fraud. Protect personal information. Respect due process.

Because the government should protect our elections without treating every American voter like a potential suspect.

Security without constitutional limits is not liberty.

That’s how we #GoRight.

A federal lawsuit alleges that the Trump administration has collected voter information from at least 47 states and combined sensitive records with other databases. The case raises major questions about election integrity, federal authority, privacy, and government surveillance. Peter Boykin explains why protecting American elections and protecting Americans’ constitutional liberties must go hand in hand.
