Trump’s Immigration Crackdown Hits a Constitutional Wall

A federal judge has dismissed the Trump administration’s lawsuit challenging New York City’s sanctuary policies, delivering a significant setback to federal efforts to force greater local cooperation with immigration enforcement.

The ruling does not prevent federal immigration agents from enforcing immigration laws. Instead, it addresses whether Washington can require state and local officials to assist federal authorities.

The constitutional question is simple: Can the federal government force local governments to use their employees, jails, and taxpayer resources to carry out federal immigration policies?

The court says the Trump administration has not established the legal authority to do so in this case. Reuters

Washington Has Authority, But Not Unlimited Authority

U.S. District Judge Ramón Reyes Jr. dismissed the Justice Department’s lawsuit against New York City after examining restrictions on local cooperation with Immigration and Customs Enforcement.

The administration argued that the city’s sanctuary policies interfered with federal immigration enforcement, endangered officers, and conflicted with federal law.

Those policies limit when local police and correctional officials can honor immigration detainers, share custody information, or use city resources for federal civil immigration enforcement.

The judge concluded that the federal government lacked standing to pursue its claims. He also explained that the challenged policies did not violate federal immigration law and that compelling local assistance would conflict with the Tenth Amendment’s protections against federal commandeering of state and local governments.

One important distinction involves information sharing. Federal law protects the exchange of certain citizenship and immigration-status information. However, the court determined that information about an individual’s release date or whereabouts is not automatically the same thing as citizenship-status information.

The ruling does not legalize unlawful immigration, prevent ICE from making lawful arrests, or require other states to adopt sanctuary policies.

It also does not resolve every legal question surrounding immigration cooperation.

North Carolina has taken a different approach. State lawmakers enacted House Bill 318, expanding requirements for county sheriffs and detention facilities to cooperate with ICE in specified circumstances.

That distinction matters. A state choosing through its own laws to cooperate with federal immigration authorities is different from Washington attempting to compel that cooperation.

The New York decision is a district court ruling, not a nationwide Supreme Court decision. The Justice Department may pursue an appeal.

The broader dispute over sanctuary policies and federal immigration authority remains unresolved. Courthouse News

Strong Borders Don’t Require Unlimited Government

The Go Right with Peter Boykin Perspective

First of all, I support President Donald Trump. But I am here to deliver the news, not simply tell people what they want to hear.

I support strong borders, immigration enforcement, deporting individuals who are unlawfully present through proper legal procedures, and holding criminals accountable.

I also oppose sanctuary policies that unnecessarily obstruct cooperation with federal authorities, particularly when dangerous criminals are involved.

But supporting immigration enforcement does not mean abandoning the Constitution.

The federal government has broad authority over immigration. That does not give Washington unlimited authority over state and local governments.

The Tenth Amendment matters just as much when Republicans control the White House as when Democrats do.

I believe states should cooperate with legitimate federal immigration enforcement efforts, especially when public safety is at stake.

But I also believe cooperation should follow constitutional law rather than political pressure.

North Carolina has exercised its legislative authority to establish cooperation requirements. New York has chosen a different approach.

We can criticize New York’s policies. We can argue that they undermine public safety. We can demand accountability when dangerous individuals are released.

But we must still recognize the constitutional distinction between federal enforcement authority and federal control over local government.

The answer is not to weaken immigration enforcement.

The answer is to strengthen lawful cooperation, improve communication between agencies, and ensure that federal officials have the resources necessary to enforce immigration laws themselves.

A strong federal government is not the same thing as an unlimited federal government.

That principle should never change depending on which political party occupies the White House.

Enforce the Law. Respect the Constitution.

The ruling represents another important development in the legal battle over sanctuary jurisdictions.

The next questions are whether the Justice Department appeals, how courts continue interpreting the Tenth Amendment, and whether Congress considers legislation addressing federal and local immigration cooperation.

Public safety matters. Immigration enforcement matters. State sovereignty matters.

None of those principles requires abandoning the others.

Secure the border. Enforce immigration law. Protect communities. Respect constitutional limits.

Because the Constitution is not an obstacle to legitimate government. It is the framework that gives government its lawful authority.

We don’t just go right. We go constitutionally right.

That’s how we #GoRight.

A federal judge has dismissed the Trump administration’s lawsuit against New York City’s sanctuary policies, ruling that Washington cannot compel local governments to assist federal immigration enforcement in the manner sought. What does the decision mean for immigration enforcement, state sovereignty, and North Carolina? Peter Boykin examines why strong borders and constitutional limits must coexist.
