When Montana voters cast their ballots in this year’s midterm election, they were also asked to vote on a matter of life and death for babies born after botched abortions… And they chose death.

Background: Sometimes when a pregnant woman goes for an abortion, the baby ends up surviving the abortion and is born alive. Studies suggest this is a less than 1% occurrence.

The details: A bill called the ‘Montana Born-Alive Infant Protection Act’ asked voters to make it illegal for a doctor not to provide medical care to the baby and leave it to die on a cold metal operating table.

The referendum read:

“A born-alive infant means an infant who breathes, has a beating heart, or has definite movement of voluntary muscles, after the complete expulsion or extraction from the mother.”

Montana voters chose to let the babies die. While just 92% of the vote has been counted, the margin is wide enough that the referendum has already been shut down.

The margins were:

52.6% said no

47.4% said yes

Big picture: In 2002, Congress passed a law that made it illegal to actively kill the baby once it’s born alive. But it did not go as far as to require doctors to provide medical care to the child.
