OBAMA JUDGE OPENS THE BORDER
A federal judge blocked the use of Title 42 at the southern border, effectively opening the border by stripping one of the few rules in place that allowed border patrol to turn people away.
Back up: Title 42 is the Trump-era immigration rule that allowed border patrol to quickly send illegals back across the border, citing public health concerns from the Covid pandemic.
The ruling: Judge Emmet Sullivan, an Obama appointee to the U.S. District Court in D.C., called the Trump-era rule “arbitrary” and said it ignored “the codified procedural and substantive rights of non-citizens seeking safe harbor.”
“Rights of non-citizens.”
Texas Gov. Greg Abbott tweeted in response to the ruling, saying: “This will further signal to cartels, human smugglers, & illegal immigrants that the border is wide open—inciting more violence & lawlessness. Disastrous.”
Big picture: The October 2022 data from Customs and Border Protection that found 230,678 illegal aliens were encountered at the border last month – a 334% increase from the same time last year.
This isn’t the first attack on Title 42 from left-wing activists [Judge Sullivan is a left-wing activist in a robe].
The ACLU sued to stop the rule in 2021
The Biden regime tried to end the policy earlier this year
…both of these prior attempts failed.
What happens next?
The Biden regime has asked the judge to delay his ruling for 5 weeks so it could prepare for “an orderly transition to new policies.” The judge obliged them.
So Title 42 will officially end on December 20. I guess that’s Biden’s Christmas gift to the drug cartels.
