Amid ongoing discussions within the Biden administration, a contentious plan is taking shape, aiming to grant legal status to hundreds of thousands of migrants residing unlawfully in the United States and married to American citizens. This proposal, if enacted, would significantly alter the immigration landscape, prompting both fervent support and vehement opposition.
The reported plan, as detailed by The Wall Street Journal, centers on leveraging an immigration mechanism called “parole in place” to provide deportation relief or work permits to illegal alien spouses in mixed-status families. These families typically comprise one illegal alien parent and spouses and children who are U.S. citizens or legal permanent residents.
Parole in place, an existing program primarily utilized for the spouses of military veterans, grants temporary stay to foreign nationals who entered the U.S. illegally. Advocates within the administration believe that extending this provision to illegal alien spouses could streamline their green card applications and facilitate a pathway to citizenship.

Moreover, concerns about the escalating crisis at the southern border loom large, with over 2 million migrant encounters recorded in fiscal year 2023 and another 1 million in the first five months of fiscal year 2024.
