My argument presents a strong case for why the NC GOP platform, particularly its stance on marriage, should be reconsidered in light of constitutional principles and evolving societal norms.
The current NC GOP platform, specifically Article 1 about family, asserts that “traditional marriage and family, based on marriage between one man and one woman, is the foundation for a civil society.” It supports actions to return marriage laws to the states and endorses a marriage amendment in the North Carolina constitution. This position is outdated and inconsistent with recent Supreme Court decisions and federal legislation recognizing diverse forms of marriage.
1. **Supreme Court Decisions**: The Supreme Court has affirmed that marriage rights extend beyond traditional definitions. The landmark case Obergefell v. Hodges (2015) established that same-sex marriage is a constitutional right, making any state-level attempts to restrict this right unconstitutional.
2. **Federal Recognition**: The Respect for Marriage Act, passed by Congress, requires that all states recognize marriages legally performed in other states, ensuring uniformity across the nation.
Comparing marriage rights to the issue of abortion and state rights is flawed. Marriage, unlike abortion, involves lifetime legal agreements and benefits that should be consistently recognized across all states. Allowing states to individually decide marriage laws would create legal chaos and inequality.
North Carolina’s Constitution, in Section 13, emphasizes religious liberty, stating that “no human authority shall, in any case whatever, control or interfere with the rights of conscience.” The NC GOP’s stance on marriage is primarily rooted in specific religious beliefs, conflicting with the First Amendment of the U.S. Constitution, which ensures the separation of church and state. The establishment clause prevents the government from favoring one religion over another, promoting a secular legal framework for marriage.
The NC GOP, and the broader GOP, should reflect the diversity of its members and the wider electorate. Former President Donald Trump acknowledged the legal status of same-sex marriages and the decisions of the Supreme Court and Congress. It is crucial for the party to move beyond outdated and exclusionary views on marriage to embrace a more inclusive approach.
North Carolina’s voter base is predominantly unaffiliated, with the Republican party ranking third in registered voters. To resonate with a broader demographic and truly embrace the principles of “Make America Great Again,” the party must avoid policies that alienate certain groups. Strong families and marriages can be championed without imposing restrictive, faith-based definitions.
As a Openly Gay Republican and Founder of Gays For Trump as well in a long-term 28 year relationship, and a child of a Heterosexual Marriage of over 50 years I see the importance of strong marriages and families. Our policies should reflect this without alienating members of the LGBTQ community or other diverse groups. The GOP should strive to be a big tent party, inclusive of all Americans. We should extend the same outreach to the LGBTQ community that we offer to people of color and other minorities, recognizing that our Constitution’s preamble begins with “We the People” for a reason.
To truly serve the diverse citizens of North Carolina and the nation, the NC GOP must adapt and uphold the constitutional rights of all individuals. By doing so, we honor our commitment to liberty and equality, ensuring that the Republican party remains relevant and welcoming to all who share our values of freedom and strong families.
