The Public Interest Legal Foundation (PILF) is contesting a federal court ruling that halted its mission to purge Michigan’s voter rolls of approximately 26,000 deceased individuals. Simultaneously, the Republican National Committee (RNC) is leveling accusations against Michigan Secretary of State Jocelyn Benson for neglecting to update the permanent mail ballot list by removing 92,000 inactive registrants.
PILF has filed an appellate brief with the Sixth Circuit Court of Appeals, aiming to overturn a decision made by U.S. District Court Judge Jane Beckering. Appointed by Joe Biden, Judge Beckering asserted that Michigan conducts a “regular and ongoing” effort to remove ineligible voters, thereby dismissing PILF’s lawsuit which argued to the contrary.
PILF originally sued Benson in November 2021, alleging that her failure to remove approximately 26,000 deceased individuals from the state’s voter rolls was a violation of the National Voter Registration Act of 1993. This federal law mandates states to make “a reasonable effort to remove the names of ineligible voters from the official lists of eligible voters.”
In its appeal, PILF highlighted that the district court denied its requests to depose Benson and a member of her staff. Additionally, efforts to depose ERIC, a third-party organization that assists Michigan in managing voter lists, were rejected by both a magistrate judge and Judge Beckering.
In a separate lawsuit, the RNC alleges that Benson’s office has failed to update the state’s permanent mail ballot list, which includes nearly 92,000 inactive voters. The RNC contends that this failure to remove these outdated entries violates state law and could result in widespread distribution of absentee ballots to incorrect addresses.
An alarming 20 percent of respondents in a Rasmussen poll on voting by mail admitted to fraud in the current year, a figure substantial enough to potentially have influenced the 2020 election.
From a constitutionalist viewpoint, ensuring the integrity of voter rolls is essential for preserving the sanctity of our Constitutional Republic. The presence of deceased and inactive voters on these lists undermines public confidence in our electoral processes. The allegations against Secretary of State Benson, if substantiated, reveal a concerning lapse in adherence to both federal and state laws designed to maintain accurate voter registration lists.
The dismissal of PILF’s lawsuit by Judge Beckering raises questions about the judiciary’s role in enforcing the National Voter Registration Act. By denying PILF’s requests to depose key figures, the court may have hindered a thorough examination of the processes in place to remove ineligible voters. This decision could set a precedent that allows for less transparency and accountability in the management of voter rolls.
Furthermore, the RNC’s lawsuit highlights a critical issue with the distribution of absentee ballots. If inactive voters remain on the permanent mail ballot list, there is a significant risk of ballots being sent to outdated addresses, which can lead to potential misuse and fraud. Ensuring that only eligible and active voters receive ballots is paramount to safeguarding the integrity of our elections.
