BIDEN DOES NOT HAVE LEGAL AUTHORITY TO CANCEL STUDENT LOANS

In what was meant to be a confidential report, the top Department of Education (DOE) lawyer during the Obama administration says that Joe Biden does not have the constitutional authority to forgive student loan debt.
Back up: Biden is reportedly seriously considering canceling a large portion of the $1.6 trillion dollars in student loan debt currently held by borrowers.
Charlie Rose, who served as the Obama admin’s top DOE lawyer from 2009 to 2011, wrote a legal analysis for his law firm in May 2021 detailing the shaky legal ground Biden would be on if he tried to follow through with student loan forgiveness. It said:
- “If the issue is litigated, the more persuasive analyses tend to support the conclusion that the Executive Branch likely does not have the unilateral authority to engage in mass student debt cancellation.”
Mr. Rose confirmed that the memo was authentic, although he said it was prepared for a private client and never intended to be made public.
Student loan forgiveness was a major campaign promise for Biden that his younger supporters vocally remind him of often.
