The court emphasized that the president does not need a governor’s consent to assume command of state National Guard forces when acting under federal authority.
California Gov. Gavin Newsom had filed a lawsuit claiming Trump violated his rights as governor by not consulting him. The court rejected this, stating:

The Ninth Circuit’s unanimous ruling wasn’t simply a procedural win; it was a thunderous affirmation of the President’s Article II authority under the Constitution. It reaffirmed what the Founders designed: that in times of national emergency, the President must have the undisputed ability to act decisively in defense of the people, even when certain governors, like Gavin Newsom, stand in the way for political theater.
