MASSIVE WIN FOR THE 2ND AMENDMENT

The Supreme Court struck down a New York state law that required citizens to demonstrate “proper cause” in order to obtain a concealed weapons permit, ruling that it violated the Second Amendment.

All 6 conservative Justices voted to overturn while the 3 liberals dissented.

Back up: The case, New York State Rifle & Pistol Association Inc. v. Bruen, was brought after two men were denied a concealed carry license based on a New York law written in 1911 that requires the applicants to show “proper cause” and “good moral character.”

 

Justice Clarence Thomas wrote the majority opinion, which basically says it’s unconstitutional to make a U.S. citizen prove their worthy of exercising their constitutional rights. Here are some quotes:

“The Second and 14th Amendments protect an individual’s right to carry a handgun for self-defense outside the home.”

“New York’s proper-cause requirement violates the Fourteenth Amendment in that it prevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms.”

The Fourteenth Amendment essentially says that states cannot pass a law that contradicts the Constitution.

Joe Biden reacted to the decision, saying: “I think it is a bad decision. I think it isn’t reasoned accurately. I’m disappointed.”

 

Big picture: This will have a national-wide effect. Justice Thomas specifically calls out California, Hawaii, Maryland, Massachusetts, and New Jersey + Washington D.C for laws that share the same constitutional flaw that New York’s law had.

 

In related news: On the same day the Supreme Court defended gun rights, the Senate voted 65-33 to infringe gun rights, passing a gun control bill that includes red flag laws, which allow the state to confiscate your firearms without due process.

15 Republicans voted with all 50 Democrats.

The bill heads to the House today, where it will likely pass easily.
