When Election Security Meets Constitutional Rights

What happens when the federal government says it is protecting elections, but a federal judge says its methods may be violating the law?

That’s the controversy now facing the Trump administration.

Just days before the November 3 midterms, a federal judge has temporarily restricted the Justice Department and Department of Homeland Security from pressuring election officials over disputed voter eligibility.

The administration says it’s trying to prevent noncitizens from voting.

The judge says its actions likely crossed constitutional and legal boundaries.

So who is right?

And more importantly, how do we protect the integrity of our elections without violating the rights of lawful American voters?

Because election integrity should never mean choosing between security and the Constitution.

FIRST OF ALL, I SUPPORT TRUMP. But I am here to deliver the news.

I’m Peter Boykin, the Constitutionalist for Liberty, and this is The Go Right with Peter Boykin Perspective.

Today we’re talking about something every American should care about.

Secure the vote. Respect the law. Protect the people.

Election Integrity Is Not Optional

I believe American elections should be decided by eligible American voters.

I support verifying citizenship.

I support accurate voter rolls.

I support investigating credible allegations of fraud.

And I support prosecuting individuals who knowingly violate election laws.

Those principles should not be controversial.

But there is another principle that matters just as much.

Government must follow the law while enforcing the law.

That applies to every administration, including one I support.

On October 30, U.S. District Judge Trina Thompson issued a temporary restraining order limiting certain actions by the Justice Department and Department of Homeland Security.

The order prohibits federal officials from demanding that state and local election workers remove voters, separate ballots, or interrupt ballot processing based solely on disputed claims of ineligibility.

It also restricts threats of criminal prosecution against election workers performing their lawful duties.

The judge concluded that the government’s conduct likely violated federal protections against voter intimidation.

Now, that is a preliminary ruling.

It does not establish that every disputed voter is eligible.

It does not prohibit legitimate criminal investigations.

And it does not mean noncitizens suddenly have the right to vote in federal elections.

The court is addressing the methods being used to enforce election law.

That distinction matters.

Due Process Protects Everyone

Imagine being an American citizen who has voted lawfully for years.

Suddenly, a government database identifies you as potentially ineligible.

Perhaps your records are outdated.

Perhaps a clerical mistake occurred.

Perhaps your naturalization information was never properly updated.

Should your ballot automatically be discarded?

Of course not.

The government should investigate and verify the facts.

And if you are an eligible voter, your ballot should count.

Now consider the opposite situation.

Someone knowingly registers to vote despite being ineligible.

Should the government simply ignore that?

Absolutely not.

Investigate it.

Prove the violation.

And enforce the law.

These positions are not contradictory.

They are exactly how constitutional government is supposed to function.

Election integrity means preventing unlawful votes while protecting lawful ones.

Strong Enforcement Still Needs Constitutional Limits

I support President Trump’s efforts to secure our borders and enforce immigration laws.

I understand the administration’s concern about noncitizen voting.

But I also believe that federal officials must respect the responsibilities of state election authorities and the constitutional protections of American citizens.

The federal government has legitimate authority to enforce federal election laws.

States have substantial authority to administer elections.

Neither possesses unlimited power.

And neither should use threats or intimidation to force election workers into actions that violate established law.

The same constitutional standard should apply if Democrats control the White House.

If President Biden had attempted to pressure election officials into disregarding lawful procedures, I would have questioned that conduct.

I cannot abandon that position simply because President Trump is now in office.

That’s not how constitutional principles work.

Courts Are Part of the System, Not the Enemy

I also want to address something I hear frequently in political discussions.

Whenever a federal judge rules against a president, people immediately accuse the court of political interference.

Sometimes judicial decisions absolutely deserve criticism.

Judges are not infallible.

They can misinterpret statutes.

They can misunderstand constitutional authority.

And their decisions can be appealed or reversed.

But courts exist precisely because executive authority is not unlimited.

The Constitution created an independent judiciary to resolve disputes about the law.

We cannot demand that courts enforce constitutional limits against Democrats and then complain that courts have no authority whenever they rule against Republicans.

The standard must remain consistent.

We should evaluate judicial decisions based on their reasoning, the Constitution, and applicable law.

Not simply on whether we like the political outcome.

The Vote Belongs to We the People

There is something bigger at stake than the November election.

Public confidence in American elections matters.

If Americans believe ineligible votes are being counted, confidence suffers.

If eligible Americans believe their votes may be rejected because of an unverified government allegation, confidence also suffers.

And if election workers believe they could be threatened for performing their lawful responsibilities, the election system itself becomes vulnerable.

We need rules that are clear.

Processes that are transparent.

Investigations supported by evidence.

And government officials willing to respect constitutional boundaries.

That is how trust is maintained.

Not through political slogans.

Not through threats.

And not through assuming that every allegation is automatically true.

Protect the Vote, Protect the Constitution

At the end of the day, I want every lawful American vote counted.

And I want every unlawful vote prevented from affecting the outcome.

Those goals should work together.

We should secure our elections without abandoning due process.

We should enforce immigration law without disregarding constitutional restrictions.

And we should hold government officials accountable without turning election administration into a political battlefield.

I want Republicans to win because their policies deserve the support of the American people.

But election security must never be about manufacturing a political advantage.

It must be about protecting the legitimacy of our Constitutional Republic.

Secure the vote. Respect the law. Protect the rights of the people.
