The Trump administration says a federal review has identified hundreds of thousands of voter-registration records that may belong to noncitizens.

Critics from the left and several state election offices say the claim is exaggerated, unsupported by publicly released evidence, or based on federal databases that were not designed to serve as final determinations of voting eligibility.

Both sides are rushing toward conclusions that the available evidence does not yet justify.

A potentially suspicious database match is not proof that a noncitizen voted. It is also not something election officials should automatically ignore.

Citizenship Is a Legitimate Voting Requirement

Federal law generally prohibits noncitizens from voting in elections for president, vice president, Congress, or presidential electors. Voter-registration materials also require applicants to attest that they are United States citizens.

There is nothing radical or discriminatory about requiring voters in federal elections to be citizens.

Citizenship is one of the basic qualifications that gives a person the right to select the officials who exercise the sovereign power of the United States.

Election officials also have a responsibility to maintain accurate voter lists. Federal law requires states to operate centralized voter-registration systems, while state and local officials remain primarily responsible for determining eligibility and maintaining those records. The question is not whether voter rolls should be accurate.

The question is how the government proves that a particular person is ineligible before removing that person’s registration.

A Database Match Is the Beginning of an Investigation

The Department of Homeland Security reportedly told California, New Jersey, Nevada, and Pennsylvania that federal comparisons had identified more than 250,000 potentially ineligible registrations. The administration has separately cited a nationwide figure of approximately 278,000 possible noncitizen registrations. State officials have disputed the findings and said the federal government has not publicly provided enough evidence to validate the claims. (Reuters)

The word potentially matters.

Immigration databases may contain outdated information. A legal permanent resident can later become a naturalized citizen. Names can be entered differently across government systems. Dates of birth may be wrong. Multiple people may have similar personal information.

The federal SAVE system was originally developed to help government agencies verify immigration status for public benefits and other authorized purposes. A match in that system can provide useful information, but it should not be treated as a final verdict without additional verification. (SAVE)

Reuters found that some naturalized citizens have been incorrectly flagged when immigration records did not reflect their current citizenship status. Its review also found relatively few federal prosecutions for noncitizen voting compared with the size of the national electorate. (Reuters)

That does not prove every one of the administration’s matches is wrong.

It proves that government databases make mistakes and that American citizens need a meaningful opportunity to correct them.

Registration Is Not the Same as Voting

Political arguments frequently combine three different categories:

A person may be mistakenly listed as registered.

A noncitizen may have registered accidentally or unlawfully.

A noncitizen may have actually cast a ballot.

Those are not the same offense, and they should not be reported as though they are interchangeable.

The administration should release enough information for states, courts, and the public to determine how the number was produced.

How many records represent people who later became citizens?

How many contain conflicting information?

How many registrations are inactive?

How many individuals actually voted?

How many cases have been referred for prosecution?

How many have been confirmed as data errors?

Without those answers, the number remains an allegation produced by a comparison process, not proof of 278,000 illegal votes.

Critics are therefore justified in demanding evidence.

They go too far when they insist that noncitizen registration never occurs or that checking the rolls is automatically voter suppression.

Due Process Protects Election Integrity

A responsible voter-list review should use several identifiers rather than relying on names alone. Election officials should compare dates of birth, addresses, identification numbers, citizenship records, and registration histories.

Anyone flagged should receive written notice explaining the reason, the evidence involved, and how to correct the record.

Naturalized citizens should be able to resolve mistakes quickly without hiring an attorney or navigating an impossible bureaucracy.

Confirmed citizens should remain registered.

Confirmed noncitizens should be removed from federal-election rolls according to state and federal law.

Evidence of intentional illegal registration or voting should be referred for prosecution.

The government should then publish anonymized totals showing the number flagged, confirmed, corrected, removed, and prosecuted.

That approach would protect both election security and the rights of eligible voters.
