The New Mexico Attorney General Rejects Governor Gun Control Order Citing Constitutional Concerns
In a bold stand for constitutional rights, New Mexico Attorney General Raul Torrez, himself a Democrat, has refused to defend Governor Michelle Lujan Grisham’s executive order, which suspends open and concealed carry rights in Albuquerque and Bernalillo County for 30 days. Torrez firmly believes the order infringes upon citizens’ Second Amendment rights and is “near certain” to violate the U.S. Constitution.
Governor Grisham issued the order on September 7, citing recent gun-related tragedies, including the tragic death of an 11-year-old boy near a minor league baseball stadium. The order, classified as an emergency public health measure, has sparked controversy and legal challenges.
Torrez, in a letter to Governor Grisham, expressed his reluctance to defend the order in two lawsuits. He stated, “Though I recognize my statutory obligation as New Mexico’s chief legal officer to defend state officials when they are sued in their official capacity, my duty to uphold and defend the constitutional rights of every citizen takes precedence. Simply put, I do not believe that the Emergency Order will have any meaningful impact on public safety but, more importantly, I do not believe it passes constitutional muster.”
While acknowledging the gravity of gun violence, Torrez urged the governor to engage in a more deliberate and collaborative legislative process instead of unilateral executive action that encroaches upon law-abiding citizens’ constitutional rights.
In a detailed four-page letter, Torrez criticized the attempt to classify the situation as a “public health emergency,” asserting it is fundamentally a public safety issue. He made it clear that the executive order is “near certain” to infringe upon the Second Amendment of the U.S. Constitution.
Responding to the criticism, Grisham’s press secretary, Caroline Sweeney, clarified that the governor did not request Attorney General Torrez to defend the order in court. Sweeney emphasized that the order aims to address state laws under the governor’s jurisdiction and does not suspend the Constitution.
In response to the controversy, Republican state Representatives Stefani Lord and John Block have called for Governor Grisham’s impeachment. Lord argued, “This is an abhorrent attempt at imposing a radical, progressive agenda on an unwilling populous. Rather than addressing crime at its core, Governor Grisham is restricting the rights of law-abiding gun owners.”
In an interview with Fox News Digital, Representative Lord described Grisham as a “rogue governor.”
The National Association for Gun Rights and Albuquerque resident Foster Haines have filed a lawsuit challenging the emergency order’s constitutionality. They are seeking a temporary restraining order to halt its implementation. This legal battle underscores the ongoing debate over individual rights, public safety, and the role of executive orders in addressing complex societal issues.
