Election Security Cannot Become an Election Emergency

Election integrity is a legitimate government responsibility.

States should maintain accurate voter rolls. Voting systems should be secure. Ballots should be protected. Election workers should follow the law. Credible allegations should be investigated without fear or favoritism.

None of that gives a president unlimited power over an election.

As political arguments intensify ahead of the 2026 midterms, critics have raised concerns that emergency authority could be used to interfere with state election administration or suspend ordinary legal limits.

The Constitution does not contain a general presidential emergency-powers clause. Emergency actions ordinarily must rest on a specific constitutional or statutory authority. (Legal Information Institute)

Declaring an emergency does not allow a president to invent powers that Congress never provided.

The President Does Not Run Congressional Elections

The Elections Clause gives state legislatures initial authority over the times, places, and manner of congressional elections. It also gives Congress power to make or alter those regulations.

The executive branch still has important responsibilities.

The Justice Department can investigate election crimes. Federal agencies can address foreign interference, cyberattacks, threats, and violations of federal civil-rights laws. The president can ask Congress to pass national election legislation.

Those powers do not include rewriting election rules by personal decree because the president dislikes a state’s procedures or fears a political loss.

A Real Emergency Still Requires Law

A hurricane, terrorist attack, cyberattack, war, or natural disaster could disrupt an election.

When that happens, state officials, courts, and legislatures may need to extend hours, relocate polling places, protect voting equipment, or reschedule a primary under existing law. The National Conference of State Legislatures notes that state emergency procedures differ and may involve governors, legislatures, and courts. (NCSL)

Even a genuine catastrophe does not create unlimited authority.

The National Emergencies Act allows a president to declare a national emergency, but the declaration activates powers found in other laws. It is not a blank check.

The government would still need to identify the statute authorizing each action.

Losing Is Not an Emergency

A party losing control of Congress is not a national emergency.

An unfavorable poll is not an emergency.

A prediction market moving against the president’s party is not an emergency.

A state using rules the president dislikes is not automatically an emergency.

Evidence of a coordinated foreign cyberattack, destruction of ballots, organized intimidation, or criminal manipulation should be investigated immediately.

The response should still follow the law.

Preserve evidence. Secure equipment. Seek court orders. Arrest identified offenders when probable cause exists. Inform Congress. Allow states to continue lawful voting wherever possible.

Emergency power should protect the election, not replace it.

Conservatives spent years condemning the use of emergency declarations to expand government power during COVID-19.

That lesson cannot disappear when a Republican occupies the White House.

Emergency power is dangerous because it allows officials to claim that normal limits are too slow, inconvenient, or outdated. Sometimes swift action is necessary. That is exactly why every emergency action must have a clear legal basis, narrow purpose, limited duration, and judicial review.

Election security must begin with evidence.

If there is fraud, prove it.

If there is foreign interference, expose it.

If officials broke the law, prosecute them.

If a voting system failed, audit it.

But no president should be allowed to declare an election emergency merely because voters may deliver an unwanted result.

The Constitution does not belong to the winning party. It exists to restrain every party, especially when political power is at stake.

Election emergencies can arise from disasters, attacks, or major system failures, but emergency authority cannot become a presidential shortcut around state administration, Congress, courts, or election results.
