The Texas GOP Says It Defends Liberty, So Why Is It Targeting Gay Families?
By Peter Boykin
Gays For Liberty
The Republican Party should be the political home of limited government, individual liberty, religious freedom, personal responsibility, and equal protection under the law.
That promise becomes difficult to defend when a Republican platform calls for the government to invalidate legal marriages, restrict qualified gay adults from adopting children, and treat an entire class of American families as legally inferior.
The Republican Party of Texas has approved a 2026 platform that continues its opposition to same-sex marriage. The document calls for the Supreme Court’s decision in Obergefell v. Hodges to be nullified, rejects same-sex parenting, supports restricting adoption to married or single heterosexuals, and urges resistance to federal policies conflicting with Texas’s definition of marriage.
This is not merely an argument for protecting churches from government coercion. It is a political demand for government to withdraw civil recognition from gay couples and families.
Religious Freedom Does Not Require Civil Inequality
Churches have a First Amendment right to define marriage according to their faith. No minister should be forced to perform a ceremony that violates his or her convictions. Religious organizations should remain free to establish their own doctrines, membership requirements, and sacramental practices.
Those protections do not require the government to invalidate somebody else’s civil marriage.
A marriage license issued by the state is not a church sacrament. It is a civil instrument affecting property, inheritance, taxation, medical decisions, parental rights, survivor benefits, and countless other legal responsibilities.
Government can protect the religious freedom of those who believe marriage is between one man and one woman while also recognizing that gay Americans are entitled to equal treatment under civil law.
Congress demonstrated that both principles can coexist when it passed the Respect for Marriage Act. The law requires federal and interstate recognition of marriages that were valid where they were performed while preserving existing constitutional and statutory religious-liberty protections.
What the Texas Platform Can, and Cannot Do
A party platform is a declaration of political priorities. It is not automatically enforceable law.
Same-sex marriage remains legal nationwide under Obergefell. The Supreme Court also denied Kim Davis’s petition challenging consequences arising from her refusal to issue marriage licenses, leaving the underlying constitutional precedent undisturbed.
The Respect for Marriage Act remains an additional statutory safeguard. It requires the federal government to recognize valid marriages and prevents states from refusing recognition to marriages legally performed elsewhere because of the couple’s sex or race.
That does not make the Texas platform meaningless. Platforms influence candidates, legislation, judicial politics, party endorsements, and the issues activists are expected to support.
The danger is not that every sentence immediately becomes law. The danger is that unequal treatment becomes normalized as an acceptable Republican objective.
These Issues Must Not Be Blurred Together
Republicans can support fairness in women’s sports, age-appropriate education, parental involvement, safeguards for children, and restrictions on sexually explicit public conduct without targeting the marriages of consenting adults.
Marriage equality is not the same question as medical treatment for minors. A private civil marriage is not a sexualized performance in front of children. Gay parents are not inherently unfit because they are gay.
Treating every LGBTQ-related issue as one inseparable political package prevents honest debate and allows ideological extremes to control the conversation.
Gays For Liberty rejects that false choice.
We can oppose inappropriate conduct without opposing gay people. We can defend biological reality without erasing civil equality. We can protect religious belief without giving government the authority to downgrade the marriages and families of its citizens.
If Liberty Is Only for the Majority, It Is Not Liberty
The Gays For Liberty Perspective
Constitutional rights cannot depend on whether a majority approves of the people exercising them.
The government should not force a church to redefine marriage. It should not force a religious minister to officiate a same-sex wedding. It also should not tell two law-abiding adults that their civil marriage, property rights, parental responsibilities, and family protections disappear because a political convention disapproves of them.
Gays For Liberty calls on Republican organizations to remove language demanding that Obergefell be nullified or that legally married gay couples be denied civil recognition.
Republicans should replace those provisions with a principled commitment to religious liberty, equal protection, parental responsibility, and government neutrality.
The Left does not own gay Americans. The Right should not reject us. Liberty belongs to everyone, or eventually it belongs to no one.
