Trump Hush Money Case Prosecution Reveals Its Weaknesses

Distraction Court Case

Distraction Court Case

Michael Avenatti, the former lawyer for Stormy Daniels, has criticized the prosecution in former President Donald Trump’s trial, asserting that their extended closing arguments signify the need for a not guilty verdict.

Avenatti’s remarks were made on X, formerly Twitter, where he stated, “The clearest sign yet that the hush money case should have never been filed or tried is the fact that the prosecution team believes they need a 4 HOUR! closing to convince the jury. This alone demonstrates loads of reasonable doubt and compels a not guilty verdict.”

Inside the courtroom, senior reporter Katherine Fung observed the trial as Trump faces allegations of falsifying business records to conceal hush money paid by his former lawyer, Michael Cohen, to adult film actress Stormy Daniels during the 2016 presidential campaign. Trump, who is the presumptive Republican nominee for the upcoming presidential election, denies any sexual relations with Daniels and has pleaded not guilty to all 34 felony counts brought by Manhattan District Attorney Alvin Bragg.

Fung noted that Trump’s defense team used over two hours for their closing arguments, while the prosecution had already surpassed three hours. This extensive duration underscores the prosecution’s struggle to present a clear and convincing case.

During a court break, Trump posted on his platform, Truth Social, exclaiming “FILIBUSTER!” and “BORING!”

In an emailed statement, Trump’s campaign spokesperson Steven Cheung condemned the trial: “The American People have witnessed in real time, the unprecedented and disgraceful weaponization of our justice system by Crooked Joe Biden’s Democrat Party.

The charges against President Trump should have never been filed and this show trial should have never occurred. The Biden Trial is craven election interference. President Trump is innocent and the American people know it, as they have now seen the absurdity of the Democrats’ un-Constitutional Witch Hunt in action.”

In my opinion, this case was NEVER about convicting Donald Trump; it was about election interference, aiming to embarrass him and hinder his campaign. This is indicated by a corrupt judge and a prosecution more interested in sensationalizing the case than proving an actual crime—a clear example of a political “nothing burger.”

Former U.S. attorney and legal analyst Barbara McQuade also weighed in, saying, “Both closings were far too long. I understand the instinct to leave no stone unturned, but human attention spans are not as long as they used to be. I think there’s a serious risk that you lose the attention of the jury if you go longer than 90 minutes or so. The goal is to help the jury see the forest for the trees. Too many trees can muddle the forest.”

Palm Beach County State Attorney Dave Aronberg provided a contrasting view, stating, “I thought the State’s closing was thorough and powerful, although I agree it could have been shorter. Still, do not confuse this with weakness. It is a product of the mountain of evidence against defendant Trump.”

During the prosecution’s closing argument, Prosecutor Joshua Steinglass emphasized what he referred to as the “smoking gun” in the case. In response, Trump lawyer Todd Blanche outlined 10 reasons for reasonable doubt, urging the jury to deliver a not guilty verdict. The defense concluded their closing argument around 12:50 p.m.
